On July 3, 2008, the Commission released a Memorandum Opinion and Order (“Order”) granting Comcast’s Petition for Determination of Effective Competition in the above captioned proceeding. On July 22, 2008, the Town of Falmouth, Massachusetts (“the Town”), filed an Application for Review (“Application”). The Town failed to timely serve the Application upon Comcast, as required by Section 1.115(f) of the Commission’s rules.1 Comcast received a copy of the Application on April 10, 2009. 2. On April 22, 2008, Comcast filed a Consent Motion for Extension of Time. Comcast states that there is a reasonable likelihood that the parties can resolve this matter amicably, and that a brief extension will assist in these endeavors. They request an extension until May 15, 2009 to either resolve this matter with the Town, or file their Opposition to the Application. The Town’s Assistant Manager has consented to the requested extension. We grant Comcast’s request. 3. As set forth in Section 1.46(a) of the Commission's rules,2 the Commission's policy is that extensions of time shall not be routinely granted. Given the Town’s failure to timely serve the Application on Comcast as well as the fact that the parties are trying to resolve this issue, we grant an extension of time to facilitate these discussions. 4. Accordingly, IT IS ORDERED that, pursuant to Sections 4(i), 4(j), and 303(r) of the Communications Act of 1934, as amended, 47 U.S.C. §§ 154(i) and (j), and 303(r) and Sections 0.61, 0.283, and 1.46 of the Commission's rules, 47 C.F.R. § 0.61, 0.283, and 1.46, the Consent Motion for Extension of Time filed by Comcast IS GRANTED, and the deadline to file and Opposition to the Town’s Application for Review is extended to May 15, 2009. 1 47 C.F.R. § 1.115(f). 2 47 C.F.R. § 1.46.
