Washington, D.C. 20554 News Media Information 202 / 418-0500 Internet: http://www.fcc.gov TTY: 1-888-835-5322 DA 10-1097 OMB Control # 3060-1140 Released: June 18, 2010 OFFICE OF MANAGEMENT AND BUDGET GRANTS EMERGENCY APPROVAL FOR INFORMATION COLLECTION MANDATED UNDER 700 MHZ WAIVER PETITION ORDER IN PS DOCKET 06-229 On May 12, 2010, the Commission issued an Order in PS Docket No. 06-229, FCC 10-79, granting, with conditions, 21 waiver petitions filed by public safety entities (“Petitioners”) seeking early deployment of statewide or local public safety broadband networks in the 700 MHz spectrum. 1 The Order requires each Petitioner to provide specific information prior to deployment about the technical specifications of its proposed network, to provide periodic updates on the progress of its individual deployment, and to obtain a spectrum lease from the Public Safety Spectrum Trust for use of spectrum. On May 21, 2010, the Public Safety and Homeland Security Bureau released a public notice providing further guidance on the requirements set forth in the Order.2 On June 18, 2010 the Office of Management and Budget (OMB) granted emergency approval under the above-referenced OMB control number for the information collections specified in the Order. By this Public Notice, we also advise parties that, pursuant to 47 C.F.R. § 0.442 and 44 U.S.C. § 3510, filings submitted with a request for confidentiality may be shared with other Federal agencies in the course of ERIC’s review and the Commission’s consideration of the information provided. Any agencies receiving such information are subject to the same restrictions as the Commission with respect to disclosure. Parties that plan to file with a request for confidential treatment of their filing should indicate in their request for confidentiality whether they oppose disclosure to other Federal agencies under the terms of section 0.442. Finally, pursuant to 47 C.F.R. § 1.1200(a), we advise parties that presentations by other Federal agencies addressing the interoperability showings or related materials will be treated as exempt from our ex parte rules for purposes of Docket PS 06-229. We find the public interest would be served by this exemption in order to ensure adequate coordination with other interested Federal agencies while recognizing the sensitive nature of some of the information provided regarding public safety communications.
