Federal Communications Commission DA 10-1357 Before the Federal Communications Commission Washington, D.C. 20554 In the matter of Effects on Broadband Communications Networks Of Damage to or Failure of Network Equipment Or Severe Overload ) ) ) ) ) PS Docket No. 10-92 ORDER Adopted: July 22, 2010 Released: July 22, 2010 Revised Reply Comment Date: September 3, 2010 By the Chief, Communications Systems Analysis Division: 1. On April 21, 2010, the Commission released a Notice of Inquiry (Notice) in the above- captioned proceeding, seeking comment to enhance its understanding of the present state of survivability of broadband communications networks.1 In broad terms, the Commission’s goal is to explore potential measures to reduce network vulnerability to failures in network equipment or severe overload conditions, such as would occur in natural disasters, pandemics, and other disasters or events that would restrain our ability to communicate. Under the original terms of the Notice, comments were due on June 25, 2010, and reply comments are due on July 26, 2010. 2. On July 19, 2010, the Board of Governors of the Federal Reserve System (“Federal Reserve”) submitted a letter applauding the Commission’s efforts in this proceeding, and also requesting that additional time be offered to respond to the Notice so that all interested stakeholders would have an opportunity to provide input in this proceeding.2 3. The Commission’s general policy is that extensions of time are not routinely granted.3 However, we believe that such extensions may be warranted when, among other things, the additional time will serve the public interest.4 In the instant proceeding, we find that providing the requested limited extension would be beneficial to the development of a complete record on the issues and that granting the extension of time requested by the Federal Reserve will serve the public interest. We therefore extend the reply comment deadline to September 3, 2010. 4. Accordingly, IT IS ORDERED that, pursuant to Sections 4(i) and 4(j) of the Communications Act of 1934, as amended, 47 U.S.C. §§ 154(i) and (j), and Sections 0.191, 0.392, and 1.46 of the Commission’s Rules, 47 C.F.R. §§ 0.191, 0.392, and 1.46, the request for extension of time 1 Effects on Broadband Communications Networks Of Damage to or Failure of Network Equipment Or Severe Overload, PS Docket No. 10-92, FCC 10-62, Notice of Inquiry, Released April 21, 2010, (“Notice”). 2 See Letter from Steve Malphrus, Staff Director, Board of Governors Federal Reserve System (July 19, 2010) 3 See 47 C.F.R. § 1.46(a). 4 See, e.g., Review of the Emergency Alert System, EB Docket No. 04-296, DA 10-311, Order, Released February 24, 2010.
