Washington, D.C. 20554 News Media Information 202 / 418-0500 Internet: http://www.fcc.gov TTY: 1-888-835-5322 DA 10-1537 Released: August 13, 2010 WIRELESS TELECOMMUNICATIONS BUREAU EXTENDS TIME TO FILE OPPOSITIONS TO PETITIONS FOR RECONSIDERATION OF FREEZE ORDER WT Docket No. 10-112 Revised date for Oppositions: August 23, 2010 On May 20, 2010, the Commission adopted a Notice of Proposed Rulemaking and Order in WT Docket 10-112.1 In the Notice, the Commission sought comment regarding the adoption of consistent requirements for: (1) the renewal of wireless radio service (WRS) licenses; (2) the discontinuance of service by WRS licensees; and (3) the construction obligations of WRS licensees with spectrum licenses that have been divided, by geographic partitioning or disaggregation of the spectrum. In the Freeze Order, the Commission imposed an immediate freeze on the filing of new applications that are mutually exclusive (i.e., competing) with renewal applications. The Commission also established processes for addressing renewal applications filed during this rulemaking, and for addressing the status of currently competing renewal applications pending at that time. On August 6, 2010, CTIA – The Wireless Association (CTIA), Green Flag Wireless, LLC (Green Flag), and the Wireless Communications Association International, Inc. (WCAI) each filed petitions for reconsideration of the Freeze Order.2 On August 12, 2010, AT&T Inc., on behalf of its licensee subsidiaries, filed a motion seeking seven additional days to respond to the Green Flag Petition. May 25, 2010) (Notice and Freeze Order, respectively). A summary of the Notice was published in the Federal Register on July 7, 2010, 75 Fed Reg. 38959. 2 AT&T Services, Inc., Cricket Communications, Inc., the Rural Cellular Association, Sprint Nextel Corporation, T- Mobile USA, United States Cellular Corporation and Verizon Wireless joined the CTIA Petition. CWC License Holding, Inc., James McCotter, and NTCH-CA, Inc. joined the Green Flag Petition. Atlantic Tele-Network, Inc, and Tisdale Telephone Company, LLC filed a Petition for Partial Reconsideration and/or Clarification of the Freeze Order on June 24, 2010. 2 rules, oppositions to the petitions filed on August 6, 2010 are due Monday, August 16, 2010.3 The Commission does not routinely grant extensions of time.4 However, we find that given the complexity of the issues raised in the Green Flag Petition as well as those raised in the CTIA and WCAI Petitions, that the public interest would be served by affording all interested parties an additional seven days, until August 23, 2010 to file an opposition to any of the three petitions for reconsideration filed on August 6, 2010. We also note that Green Flag does not oppose AT&T’s Motion,5 and find that a one- week extension of the time for filing Oppositions will not prejudice any other party. Accordingly, the time for filing Oppositions to the Petitions for Reconsideration filed on August 6, 2010 is extended to August 23, 2010.
