The Commission has before it a Notice of Proposed Rulemaking1 issued in response to a petition for rulemaking jointly filed by TV 6, L.L.C., the former permittee of station KBCJ, analog channel 6, Vernal, Utah, and Kaleidescope Foundation, Inc., the former permittee of KBNY, analog channel 6, Ely, Nevada,2 requesting that the Commission amend its rules to reallot their analog channels from Vernal to Santaquin, Utah and from Ely to Caliente, Nevada. 2. The Communications Act of 1934, as amended by the DTV Delay Act, requires the Commission to “take such actions as to terminate all licenses for full-power television stations in the analog television service, and to require the cessation of broadcasting by full-power stations in the analog service, by June 13, 2009 . . ..” 3 Thus, the Commission no longer has the authority to act on rulemaking proposals in the full-power analog television service. 3. Accordingly, IT IS ORDERED that the Petition for Rulemaking to reallot analog channels 6 from Vernal to Santaquin and from Ely to Caliente IS HEREBY DISMISSED. 4.
