Federal Communications Commission Washington, D.C. 20554 February 16, 2010 DA 10-246 Michael Carter Communications Officer Stephens County Emergency Medical Services 2003 Falls Road Toccoa, GA 30577 Dear Mr. Carter: This letter grants your request, dated January 20, 2010, on behalf of Stephens County Emergency Medical Services and Stephens County Hospital for a waiver to permit certain Amateur Radio Service licensees to transmit communications on behalf of their employers during an upcoming government emergency drill. In your request, you state that Stephens County Emergency Medical Services and Stephens County Hospital will be holding a disaster preparedness drill on March 17, 2010 from 7:00 a.m. to 7:00 p.m. You state that the drill will involve ambulance communications with operators in the hospital emergency room and hospital departments heads. The drill will be held in Stephens County, Georgia. Section 97.113(a)(3) of the Commission’s Rules, 47 C.F.R. § 97.113(a)(3), prohibits amateur licensees from transmitting communications in which they have a pecuniary interest, including communications on behalf of an employer. You therefore request a waiver of this rule to permit the following amateur licensees who are employees of Stephens County Emergency Medical Services or Stephens County Hospital to transmit communications on behalf of their employers in connection with these exercises: Herbert Masten, KJ4JFI; Michael Carter, KI4AEM; Tim Bohannon, KI4BSX; James Norris, KJ4JFG; Byron Bennett, KJ4JFH; Aaron Wilkinson, KJ4JFJ; April Gettys, KF4JFK; Michael Coleman, KJ4JFL; Willie Stephens, KJ4LPU; Wesley Ayers, KJ4LPV; Bobby Westmoreland, KJ4LPW; Bill Fleming, KJ4RNF; Donna Scott, KJ4RNG; Kevin Westmoreland, KJ4RNH; Benny Evans, KJ4RNE; Teresa Sauls, KJ4QQS; Constance Rice, KJ4QQT; Faye Taylor, KJ4QQU; Shirley Churchwell, KJ4QQV; Jeffrey Laird, KJ4QQW; Robert Knox, KJ4QQX; Sherry Gragg, KJ4QQY; Vickie Ansley, KJ4QQZ; Tonya Chitwood, KJ4QVA; Rebecca Williams, KJ4QVB; Katherine Harbert, KJ4QVC; Teresa Cheek, KJ4QVD; Mary Ann Johnson, KJ4QVE; Tina DeBord, KJ4QVF; Elizabeth Hughes, KJ4QVG; Fredda Dooley, KJ4QVH; and Vickie Dobbs, KJ4QVI. Section 1.3 of the Commission’s Rules, 47 C.F.R. § 1.3, provides that the Commission may waive its rules if good cause for waiver is shown. We conclude that grant of the waiver request is appropriate under the circumstances presented. The public interest in facilitating the March 17 public safety exercise by permitting the specified amateur licensees to participate warrants this limited waiver of Section 97.113(a)(3). This waiver grant permits transmission of communications by the above-listed amateur employees on behalf of their employers during the March 17, 2010 exercise, and immediately prior to the exercise for the purpose of operational testing of equipment. Accordingly, IT IS ORDERED that the waiver request of Stephens County Emergency Medical Services and Stephens County Hospital, dated January 20, 2010, IS GRANTED.
