PUBLIC NOTICE Federal Communications Commission 445 12th St., S.W. Washington, D.C. 20554 News Media Information 202 / 418-0500 Internet: http://www.fcc.gov TTY: 1-888-835-5322 DA 10-266 Released: February 18, 2010 WIRELESS TELECOMMUNICATIONS BUREAU EXTENDS PERIOD TO FILE REPLY COMMENTS ON PETITIONS REGARDING THE USE OF SIGNAL BOOSTERS AND OTHER SIGNAL AMPLIFICATION TECHNIQUES USED WITH WIRELESS SERVICES WT Docket No. 10-4 Reply Comment Date: March 8, 2010 By this Public Notice, we extend the deadline for filing reply comments in response to the Public Notice seeking comment on three Petitions for Rulemaking and two Petitions for Declaratory Ruling (“Petitions”) regarding the proper use of signal boosters1 on frequencies licensed under Parts 22, 24, 27, and 90 of the Commission’s Rules.2 Interested parties will now have until March 8, 2010 to file reply comments, as opposed to the February 22, 2010 deadline set forth in the Public Notice.3 On February 12, 2010, the Commission received two requests for an extension of time to submit reply comments in response to the Public Notice. Wilson Electronics, Inc. (“Wilson”) filed a motion for an extension of time (“Wilson Motion”), requesting that the Commission extend the reply comment deadline to March 8, 2010.4 On the same day, CTIA – The Wireless Association (“CTIA”), PCIA – The Wireless Infrastructure Association (“PCIA”), and the Wireless Communications Association International (“WCAI”) filed a Joint Request for Extension of Reply Comment Deadline (“Joint Request”), requesting an extension of at least seven days – or no earlier than March 1, 2010 – to file reply comments.5 The Wilson Motion and the Joint Request contend that this extension is warranted due to the snow storms that affected Washington, D.C., closed the Federal Government, and delayed the posting of several comments filed in the Commission’s Electronic Comment Filing System (“ECFS”) by a week.6 1 Our use of the term “signal booster” in this Public Notice is intended to include all manner of amplifiers, repeaters, boosters, distributed antenna systems, and in-building radiation systems that serve to amplify CMRS device signals, Part 90 device signals, or extend the coverage area of CMRS providers or Part 90 service licensees. 2 Wireless Telecommunications Bureau Extends Seeks Comment on Petitions Regarding the Use of Signal Boosters and Other Signal Amplifications Techniques Used with Wireless Services, WT Docket No. 10-4, Public Notice, DA 10-14 (WTB rel. Jan. 6, 2010) (“Public Notice”). 3 Id. 4 Wilson Electronics, Inc. Motion of Wilson Electronics, Inc. for an Extension of Time (filed Feb. 12, 2010). 5 CTIA, PCIA, and WCAI, Joint Request for Extension of Reply Comment Deadline (filed Feb. 12, 2010). 6 See Wilson Motion at 1; Joint Request 1-2. Pursuant to the Public Notice, Comments were due on February 5, 2010. However, several comments were not posted on ECFS until February 12, 2010. 2 Wilson further states that “it will need additional time to adequately respond to the technical issues raised by some of the commenters.”7 It is the general policy of the Commission that extensions of time shall not be routinely granted.8 However, under these circumstances, we agree that a limited extension of time to file reply comments is warranted to ensure that the Commission obtains a complete and thorough record in response to the Petitions. Accordingly, we extend the deadline for filing reply comments until March 8, 2010.
