Anda, Captain County of Los Angeles, Sheriff’s Department 4700 Ramona Blvd. Monterey Park, CA 91754-2169 Dear Captain Anda: This letter grants your request, dated February 24, 2010, on behalf of the Los Angeles County Sheriff’s Department (Sheriff’s Department) for a waiver to permit certain Amateur Radio Service licensees to transmit communications on behalf of their employer during upcoming government emergency drills. In your request, you state that the Sheriff’s Department will be conducting emergency preparedness drills with two medical centers operated by Providence Little Company of Mary (Providence). The purpose of the exercises is to demonstrate reliable equipment operation and operator proficiency as a means of back-up communications between and among hospital facilities, law enforcement agencies, and emergency operations centers in the event that normal communications channels are unavailable. An exercise with emphasis on Providence’s Torrance facility will take place on April 22, 2010. An exercise with emphasis on Providence’s San Pedro facility will take place on June 17, 2010. In addition, radio checks will be conducted on March 26, May 4, and August 27, 2010. The drills will be held in Los Angeles County, California. Section 97.113(a)(3) of the Commission’s Rules, 47 C.F.R. § 97.113(a)(3), prohibits amateur licensees from transmitting communications in which they have a pecuniary interest, including communications on behalf of an employer. You therefore request a waiver of this rule to permit the following Amateur licensees who are Providence employees to transmit communications on behalf of their employer in connection with the exercises: JoAnn Bernier, KJ6CSO; William Elliot, KF6KOI; Patricia Feeney, KJ6CSL; Bruce Jackson, KJ6CSI; William Kemp, KJ6CSX; Craig Midget, KJ6CSQ; Pamela Oroscoe, KJ6CSM; Nicha Panich, KJ6CSJ; Alicia Segovia, KJ6CSP; Gary Sparks, KI6UKX; Leticia Vega, KJ6CSR; Judy Webber, KJ6CSK; Devin Hughie, KJ6CSV; Pamela Mitchell, KJ6CSU; Christine Barber, KJ6EMT; Dominique Davis, KJ6CST; and Christopher Riccardi, WW6WTF. Participants for the Sheriff’s Department will be non-employee volunteers, whose participation does not require a waiver. Section 1.3 of the Commission’s Rules, 47 C.F.R. § 1.3, provides that the Commission may waive its rules if good cause for waiver is shown. We conclude that grant of the waiver request is appropriate under the circumstances presented. The public interest in facilitating the March 26, April 22, May 4, June 17, and August 27 public safety exercise by permitting the specified amateur licensees to participate warrants this limited waiver of Section 97.113(a)(3). This waiver grant permits transmission of communications by the above-listed Amateur licensees on behalf of their employer during the March 26, April 22, May 4, June 17, and August 27, 2010 exercises.
