TO RESPOND TO PUBLIC NOTICE REGARDING POSSIBLE REVISIONS TO THE FCC’S 
EAS RULES UPON ADOPTION OF THE COMMON ALERTING PROTOCOL BY THE 
FEDERAL EMERGENCY MANAGEMENT AGENCY

On March 25, 2010, the Federal Communications Commission’s (Commission) Public Safety 
and Homeland Security Bureau released a Public Notice seeking informal comment regarding revisions 
to the Commission’s Part 11 rules governing the Emergency Alert System (EAS) pending adoption of the 
Common Alerting Protocol (CAP) by the Federal Emergency Management Agency.1 Specifically, the 
Public Notice seeks informal comment regarding what, if any, changes to Part 11 might be necessitated 
by the introduction of CAP, as well as requests comment on any specific rule changes or additions that 
could advance or facilitate introduction of a CAP-based Next Generation EAS architecture.2 The Public 
Notice sets deadlines for filing comments and reply comments at 30 and 60 days after publication of the 
Public Notice in the Federal Register.
On April 15, 2010, a summary of the Public Notice was published in the Federal Register.3  
Accordingly, comments must be filed on or before May 17, 2010; and reply comments must be filed on 
or before June 14, 2010.  Comment filing instructions are set forth in the Public Notice.4 The Public
