(Alaska Telecom), filed the referenced application for assignment of a VSAT system, call sign E040025, from AtContact to Alaska Telecom. For the reason stated below, we dismiss the application as defective without prejudice to refiling.1 Section 25.112 of the Commission’s rules, 47 C.F.R. § 25.112, requires the Commission to return, as unacceptable for filing, any earth station application that is not substantially complete, contains internal inconsistencies, or does not substantially comply with the Commission’s rules. AtContact and Alaska Telecom’s application is not substantially complete and/or inconsistent, which renders it unacceptable and subject to dismissal. The deficiency is as follows: The application indicates in response to Question A20 that the proposed assignee is not directly or indirectly controlled by any other entity. Attachments to the application indicate, however, that Alaska Telecom is a wholly owned subsidiary of Calista Corporation. Those exhibits do not contain the full set of information required by Question A20, i.e., information to fully and completely identify the nature and extent of control. Because the application contains internal inconsistencies and/or does not include required information concerning the prospective assignee, Alaska Telecom, it is not substantially complete. 1 If AtContact and Alaska Telecom re-file an application that resolves the defect, they need not submit an application fee.
