In particular, the Public Notice seeks comment on the benefits and burdens of requiring commenters to file materials they cite in pleadings or ex parte notices submitted in rulemaking proceedings, so that those materials are more easily accessible to all interested parties.1 The Public Notice set deadlines for filing comments and reply comments at 30 and 45 days, respectively, after publication of a summary of the Public Notice in the Federal Register. On December 8, 2011, a summary of the Public Notice was published in the Federal Register.2 Accordingly, comments must be filed on or before January 9, 2012, and reply comments must be filed on or before January 23, 2012.
