Washington, D.C. 20554 News Media Information 202 / 418-0500 Internet: http://www.fcc.gov TTY: 1-888-835-5322 DA 11-276 FEBRUARY 11, 2011 WIRELESS TELECOMMUNICATIONS BUREAU GRANTS ADVANCED WIRELESS SERVICES LICENSE Auction 78 Report No. AUC-78 (Auction 78) On August 20, 2008, the Federal Communications Commission completed an auction of licenses in the Advanced Wireless Services (“AWS-1”) (Auction 78).1 After a preliminary review of the FCC long- form applications (FCC Form 601), the application listed in Attachment A to this Public Notice was accepted for filing.2 Upon further review, we find that the application listed in Attachment A is complete and conforms to the Commission’s rules.3 Furthermore, the Commission has received full payment, as required by Section 1.2109(a) of its rules,4 for the license listed in Attachment A. Accordingly, by this Public Notice, we announce the grant of the license listed in Attachment A.5 We grant this license pursuant to Section 309(a) of the Communications Act, 47 U.S.C. § 309(a), and section 0.331 of the Commission’s rules, 47 C.F.R. § 0.331, because it will serve the public interest, convenience, and necessity.6 1 Auction of AWS-1 and Broadband PCS Licenses Closes; Winning Bidders Announced for Auction 78, Public Notice, 23 FCC Rcd 12749 (WTB 2008). 2 Wireless Telecommunications Bureau Announces that Applications for Advanced Wireless Services Licenses Are Accepted for Filing, Public Notice, 23 FCC Rcd 14895 (WTB 2008). (“PRTC”) on October 16, 2008. On December 12, 2010, NatTel filed a request for approval to withdraw its Petition to Deny stating that, in the context of NatTel’s Chapter 11 bankruptcy proceeding, NatTel and PRTC had entered into a court-approved settlement agreement that forms the basis for the withdrawal of its petition. That filing also included a certification that neither NatTel nor its principals had received any money or other consideration for the withdrawal of its pleadings against the PRTC application.
