The Commission has before it a Notice of Proposed Rulemaking1 issued in response to a petition for rulemaking filed by George S. Flinn, Jr. (“Flinn”), the licensee of WWJX, channel 51, Jackson, Mississippi. Flinn requests the substitution of channel 23 for channel 51 at Jackson. Flinn filed comments reaffirming his interest in the proposed channel substitution. Cellular South, Inc. (“Cellular South”) filed comments in support. 2. We believe the public interest would be served by substituting channel 23 for channel 51 at Jackson. In support, Flinn explains that his proposal addresses concerns of Cellular South regarding potential interference that may occur to Long Term Evolution (“LTE”) cellular base stations operating on adjacent channel spectrum.2 In its supporting comments, Cellular South states that it believes the operation of WWJX on channel 51 “creates a substantial likelihood of destructive interference” to Cellular South’s planned wireless system in Jackson,3 and that while “complex filtering arrangements might be sufficient to eliminate all potential destructive interference” between WWJX on channel 51 and Cellular South’s wireless system, “the cleanest solution to preventing destructive interference is to relocate the Channel 51 DTV station to another available channel.”4 3. Federal Communications Commission DA 11-516 2 compliance with the principal community coverage requirements of Section 73.625(a) of the Commission’s rules, at coordinates 32-03-13 N. and 90-20-23 W. In addition, we find that this channel change meets the technical requirements set forth in Sections 73.616 and 73.623 of the Commission’s rules with the following specifications: City and State Channel Power Antenna HAAT Service Pop. Accordingly, pursuant to the authority contained in Sections 4(i), 5(c)(1), 303(g) and (r) and 307(b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204(b) and 0.283 of the Commission’s rules, IT IS ORDERED, That effective 30 days after date of publication of this Report and Order in the Federal Register, the DTV Table of Allotments, Section 73.622(i) of the Commission’s rules, IS AMENDED, with respect to the community listed below, to read as follows: City and State Channel Nos. Flinn, Jr. shall submit to the Commission a minor change application for a construction permit (FCC Form 301) specifying channel 23 in lieu of channel 51. 6.
