Washington, D.C. 20554 News Media Information 202 / 418-0500 Internet: http://www.fcc.gov TTY: 1-888-835-5322 DA 11-559 Released: March 25, 2011 WIRELESS TELECOMMUNICATIONS BUREAU EXTENDS PERIOD TO FILE REPLY COMMENTS ON PROGENY LMS, LLC PETITION FOR WAIVER OF CERTAIN MULTILATERATION LOCATION AND MONITORING SERVICE RULES WT Docket No. 11-49 Reply Comment Date: April 11, 2011 By this Public Notice, we extend the deadline for filing reply comments in response to the Public Notice seeking comment on the petition by Progeny LMS, LLC (“Progeny Petition”) for waiver of certain sections of the rules relating to the Multilateration Location and Monitoring Service (M-LMS) and request for expedited treatment.1 Interested parties will now have until April 11, 2011, to file reply comments, as opposed to the April 4, 2011 deadline set forth in the Public Notice. The Public Notice established that comments on the Progeny Petition were due on March 25, 2011. It is the general policy of the Commission that extensions of time shall not be routinely granted.5 Petitioners filed the Request today, which is the comment filing deadline. Accordingly, we decline to extend the deadline for filing comments given the lateness of the Request.6 In addition, we note that if we were to grant the Request, it is possible that some parties would be unaware of it and would file their comments by today’s deadline. An extension of today’s comment deadline may create an unfair advantage in that one or more interested parties would have additional time to file comments and to review the comments of others before filing comments. We do, however, find that a limited extension of the deadline for filing reply comments would serve the public interest, ensuring that the Commission obtains a complete and thorough record.
