Federal Communications Commission DA 11-592 Before the Federal Communications Commission Washington, D.C. 20554 In the Matter of AA UNITED CAB COMPANY Request for Cancellation of License for Station KIA206, Shelby, North Carolina ) ) ) ) ) ) FCC File No. 0004361662 ORDER Adopted: April 1, 2011 Released: April 1, 2011 By the Deputy Chief, Mobility Division, Wireless Telecommunications Bureau: 1. On March 9, 2011, Jimmy Wayne Lail requested reinstatement of the license of AA United Cab Company (AA) for Industrial/Business Pool Station KIA206, Shelby, North Carolina.1 He asserts that the license was canceled by a person who lacked authority to act on behalf of AA. For the reasons set forth below, we conclude that the requested relief should be granted. 2. On February 3, 2011, the Wireless Telecommunications Bureau’s Mobility Division granted an application to cancel the license for Station KIA206 that was filed on behalf of AA by J.W. Lail on August 23, 2010.2 In the instant request for reinstatement, Jimmy Wayne Lail states that J.W. Lail was not authorized to cancel the license. Submitted with the reinstatement request is a copy of a signed and notarized 2006 contract for the sale of AA from J.W. Lail to Jimmy Wayne Lail. 3. Based on the record before us, it appears that J.W. Lail was not authorized to request cancellation of the license for Station KIA206 on August 23, 2010. We therefore conclude that the public interest would be served by reinstating AA’s license for Station KIA206.3 4. Accordingly, IT IS ORDERED that, pursuant to Section 4(i) of the Communications Act of 1934, as amended, 47 U.S.C. § 154(i), and Section 1.41 of the Commission’s Rules, 47 C.F.R. § 1.41, the request for reinstatement of the license for Station KIA206, filed by Jimmy Wayne Lail on March 9, 2011, IS GRANTED, and the license for Station KIA206 SHALL BE REINSTATED. 5.
