Federal Communications Commission DA 11-952 Before the Federal Communications Commission Washington, D.C. 20554 In the Matter of Applications of AT&T Inc. and Deutsche Telekom AG For Consent To Assign or Transfer Control of Licenses and Authorizations ) ) ) WT Docket No. 11-65 ) ) ) ) ORDER Adopted: May 25, 2011 Released: May 25, 2011 By the Chief, Wireless Telecommunications Bureau: 1. On May 20, 2011, The Greenlining Institute (“Greenlining”) filed a motion for extension of time1 pursuant to 47 C.F.R. § 1.46 requesting a 30-day extension from May 31, 20112 to June 30, 2011 for filing Petitions to Deny in the above captioned proceeding. We deny this request. 2. Greenlining states that it did not receive an unredacted copy of the Application until May 18, 2011, and without the unredacted copy of the Application, Greenlining cannot fully develop the factual information necessary to frame a truthful and complete Petition to Deny, or to determine if a different response is appropriate.3 Greenlining states that it has limited resources to devote to this matter, and that Greenlining does not have sufficient time or resources to file a Petition to Deny by the current deadline because it is handling other time-sensitive matters as referenced in its attached Declaration.4 3. It is the Commission’s policy that extensions of time are not routinely granted under the Commission's rules, 47 C.F.R. § 1.46(a).5 In this case, we are not persuaded, under the circumstances outlined in the Motion, that Greenlining has shown good cause that granting the Motion for a 30-day extension would serve the public interest. The redacted Application and Supporting Documents in this proceeding have been publicly available to Greenlining and other interested third parties since April 28, 2011 when the Commission issued the Public Notice and established the pleading cycle.6 Third parties 1 Motion for Extension of Time, filed May 20, 2011 (“Motion”). 2 AT&T Inc. and Deutsche Telekom AG Seek FCC Consent to the Transfer of Control of the Licenses and Authorizations Held by T-Mobile USA, Inc. and Its Subsidiaries to AT&T Inc., Docket No. 11-65, Public Notice, DA 11-799 (rel. Apr. 28, 2011). 3 Motion at 2. 4 Motion at 2, and Declaration. 5 47 C.F.R. § 1.46. 6 AT&T Inc. and Deutsche Telekom AG Seek FCC Consent to the Transfer of Control of the Licenses and Authorizations Held by T-Mobile USA, Inc. and Its Subsidiaries to AT&T Inc., Docket No. 11-65, Public Notice, DA 11-799 (rel. Apr. 28, 2011). Federal Communications Commission DA 11-952 2 have been able to file to request access to the unredacted copy of the application since the release of the protective order in this proceeding on April 14, 2011.7 We find nothing in the Greenlining Motion that justifies a 30-day extension for all parties to file Petitions to Deny in the above captioned proceeding.8 4. ACCORDINGLY, pursuant to the authority contained in sections 4(i)–(j) and 5(c) of the Communications Act of 1934, as amended, 47 U.S.C. §§ 154(i)–(j), 155(c), IT IS ORDERED THAT Greenlining’s motion for extension of time in the above captioned proceeding IS DENIED. 5. These actions are taken under delegated authority pursuant to Sections 0.131 and 0.331 of the Commission's Rules, 47 C.F.R. §§ 0.131, 0.331. FEDERAL COMMUNICATIONS COMMISSION Ruth Milkman Chief, Wireless Telecommunications Bureau 7 In the Matter of Applications of AT&T Inc. and Deutsche Telekom AG For Consent To Assign or Transfer Control of Licenses and Authorizations, Docket No. 11-65, Protective Order, DA 11-674 (rel. Apr. 14, 2011). 8 We note that Greenlining itself could have requested, and obtained, access to the unredacted version of the Application earlier in the proceeding than it did. Greenlining representatives signed the acknowledgements of confidentiality on April 27, 2011; however, Greenlining failed to file these with the Commission until May 10, 2011. See Letter from Samuel S. King, General Counsel, The Greenlining Institute, to Marlene H. Dortch, Secretary, Federal Communications Commission (May 9, 2011) (filed and served May 10, 2011). Greenlining received a copy of the unredacted Application on May 18, 2011. See Motion at 2.
