Washington, D.C. 20554 News Media Information 202 / 418-0500 Fax-On-Demand 202 / 418-2830 TTY 202 / 418-2555 Internet: http://www.fcc.gov ftp.fcc.gov DA 11-973 June 1, 2011 PLEADING CYCLE ESTABLISHED FOR COMMENTS ON VERIZON AND VERIZON WIRELESS PETITION FOR DECLARATORY RULING WC Docket No. 11-95 COMMENTS DUE: July 15, 2011 REPLY COMMENTS DUE: August 15, 2011 On May 20, 2011, Verizon Communications, Inc. and Verizon Wireless (Verizon) filed a petition for declaratory ruling requesting that the costs of certain tasks that use the Number Portability Administration Center (NPAC) database but are unrelated to number portability or pooling be borne directly by the cost-causing providers, rather than shared by all telecommunications carriers.1 Specifically, Verizon asserts that these transactions, which NPAC categorizes as “LNP Type 1 intra- provider ports and ‘modifies’ of NPAC records,” do not further “the two original purposes of the database: local number portability and number pooling.”2 Verizon asserts that some providers are increasingly using the database for these transactions, which causes escalating costs, and that only those providers requesting these transactions should be required to pay for them.3 Concurrently with its petition, Verizon requested confidential treatment of its petition.4 The Chief, Wireline Competition Bureau has adopted a Protective Order that limits access to proprietary or 1 Petition of Verizon and Verizon Wireless for Declaratory Ruling to Assess NPAC Database Intra-Provider Transaction Costs on the Requesting Provider at 1-2 (filed May 20, 2011) (Petition). 2 Id. at 2, 6. “‘LNP Type 1 transactions’ or ‘intra-service provider transactions’ . . . occur when a service provider generates a transaction to port a number within its own network.” Id. at 6. As examples, Verizon states that service providers may move customers served by one switch to a different one within their network “to reorganize its network configurations or to migrate customers to newer or more efficient technology,” and “many carriers offer ‘location porting,’ which enables a customer who is not changing his or her service provider to keep his or her old phone number when moving to a new address within the same rate center.” Id. at 6-7. The other category of NPAC transactions included in Verizon’s request is known as “modifies,” which occur when a service provider makes a change within an existing record relating to its network. Id. at 7. According to Verizon, “providers often use ‘modify’ transactions to reorganize their own networks or customer services by altering the routing of calls or changing the SS7 routing information for supplementary services” and to make corrections to their data entry errors.
