Lavergne, Esq. Fish & Richardson P.C. 1425 K Street, N.W. Suite 1100 Washington D.C. 20005 Dear Mr. Gray and Mr. Lavergne: On January 12, 2012, National EBS Association (“NEBSA”) and the Catholic Television Network (“CTN”)1 objected to the Brantley County Board of Education’s (“Brantley County”) request for a Special Temporary Authorization and associated waivers to operate on the C-group channels in Appling, Jeff Davis, and Wayne Counties, Georgia.2 On September 18, 2012, however, Brantley County withdrew this request, which was granted by the Wireless Telecommunications Bureau (“Bureau”) on September 24, 2012 and was placed on public notice on October 3, 2012.3 Thus, we dismiss as moot the Objection to Application filed NEBSA and CTN. Because Brantley County withdrew its application, we find that Section 1.935(b) of the Commission’s Rules does not apply in this case. Thus we conclude that neither NEBSA nor CTN is required to make the certifications required under Section 1.935(b) of the Commission’s Rules. Accordingly, IT IS ORDERED, pursuant to Sections 4(i) and 309 of the Communications Act of 1934, as amended, 47 U.S.C. §§ 154(i), 309, and Section 1.935 of the Commission’s Rules, 47 C.F.R. § 1.935, that the Objection to Application filed by the National EBS Association and the Catholic Television Network on January 12, 2012, as well as the Response to Objection to Application filed by Brantley County Board of Education on January 26, 2012, ARE DISMISSED AS MOOT. 1 National EBS Association and the Catholic Television Network, Objection to Application (filed Jan. 12, 2012). 2 Brantley County Board of Education, Request for Special Temporary Authority; File No. 0004983181, Request for Waiver (filed Dec. 6, 2011). 3 See Wireless Telecommunications Bureau Market-Based Applications Action, Report No. 8119, Public Notice (WTB rel. Oct. 3, 2012) at 4. Mr. Todd D. Gray and Mr. Edwin N. Lavergne 2 This action is taken under delegated authority pursuant to Sections 0.131 and 0.331 of the Commission’s rules, 47 C.F.R. §§ 0.131, 0.331. FEDERAL COMMUNICATIONS COMMISSION John J.
