TO DISCONTINUE DOMESTIC TELECOMMUNICATIONS SERVICES WC Docket No. 12-72 Comp. Pol. File No. 1031 Comments Due: April 9, 2012 Section 214 Application Applicant: NET/COMM Services Corp. On February 29, 2012, NET/COMM Services Corp. (NET/COMM or Applicant), located at 118 Main St., Webb, IA 51366, filed an application with the Federal Communications Commission (FCC or Commission) requesting authority, under section 214 of the Communications Act of 1934, as amended, 47 U.S.C. § 214, and section 63.71 of the Commission’s rules, 47 C.F.R. § 63.71, to discontinue a certain domestic telecommunications service in Texas.1 By an amendment filed on March 15, 2012, NET/COMM updated the record regarding the company’s current status and the circumstances that prompted the proposed discontinuance. Accordingly, NET/COMM’s application is deemed complete as of March 15, 2012. NET/COMM indicates that it is currently able to provide wholesale long distance termination service and that it has provided this service to carrier customers in Texas. NET/COMM clarifies that it has not provided any end user retail service to any person or entity. NET/COMM states, however, that it currently does not have any customers due to attrition and that it is no longer actively marketing its services. Consequently, NET/COMM indicates that it plans to discontinue wholesale long distance termination service in Texas upon receiving approval from the Commission. NET/COMM maintains that the proposed discontinuance will not result in material harm to the public because NET/COMM currently does not have any customers and alternative services can easily be obtained from other service providers. NET/COMM asserts that it is considered non-dominant with respect to the service to be discontinued. In accordance with section 63.71(c) of the Commission’s rules, NET/COMM’s application will be deemed to be granted automatically on the 31st day after the release date of this public notice, unless the Commission notifies NET/COMM that the grant will not be automatically effective. In the application, NET/COMM indicates that it plans to discontinue wholesale long distance termination service in Texas upon receiving approval from Commission. Accordingly, pursuant to section 63.71(c) and the terms of NET/COMM’s application, absent further Commission action, NET/COMM may discontinue wholesale long distance termination service in Texas on or after April 23, 2012. This proceeding is considered a “permit but disclose” proceeding for purposes of the Commission’s ex parte rules, 47 C.F.R. §§ 1.1200-1.1216. Comments objecting to this application must be filed with the Commission on or before April 9, 2012. Such comments should refer to WC Docket No. 12-72 and Comp. Pol. File No. 1031. Comments should include specific information about the impact of this proposed discontinuance on the commenter, including any inability to acquire reasonable substitute service.
