Federal Communications Commission DA 12-961 Before the Federal Communications Commission Washington, D.C. 20554 In the Matter of TODD WILSON Licensee of Amateur Service Station WH6DWF ) ) ) ) ) ORDER OF MODIFICATION Adopted: June 18, 2012 Released: June 19, 2012 By the Deputy Chief, Mobility Division, Wireless Telecommunications Bureau: 1. Introduction. In this Order of Modification, we modify the Amateur Radio Service license of Todd Wilson (Wilson) by replacing General Class operator privileges with Technician Class operator privileges. As explained below, we take this action pursuant to an earlier order proposing to modify Wilson’s license.1 2. Background. On November 29, 2011, the American Radio Relay League Volunteer Examiner Coordinator (ARRL VEC) sent an electronic data file to the Commission requesting that the Commission issue Wilson a new General Class operator license and an amateur service station license.2 Based on this application, the Commission granted Wilson a General Class amateur service operator license and a station license for amateur service station WH6DWF on November 29, 2011. This operator license authorizes Wilson to be the control operator of an amateur station transmitting on frequency bands authorized by Section 97.301(a) and (d) of our Rules.3 3. By correspondence dated January 13, 2012, ARRL VEC notified the Commission that it had made an error in the November 29, 2011 data file and that Wilson was qualified for a Technician Class operator license but not a General Class operator license.4 Therefore, ARRL VEC requested that we modify Wilson’s license to correct the operator privileges authorized. Consequently, we proposed to modify the license to show Technician Class operator privileges.5 4. Discussion. The Order of Modification was released on March 15, 2012. Wilson did not protest the proposed modification of his license within the requisite thirty-day time frame.6 Accordingly, he is deemed to have consented to the proposed modification.7 Based on the record before us, we 1 See Todd Wilson, Order Proposing Modification, 27 FCC Rcd 2588 (WTB MD 2012) (Order Proposing Modification). 2 See File No. 0004970776 (filed Nov. 29, 2011). 3 See 47 C.F.R. § 97.301(a), (d). 4 E-mail dated January 13, 2012, from Perry Green, ARRL VEC to Nancy Gilbert, Federal Communications Commission. 5 See Order Proposing Modification, 27 FCC Rcd at 2588-89 ¶ 5. 6 See 47 C.F.R. § 1.87(g)(1). 7 See 47 C.F.R. § 1.87(h). Federal Communications Commission DA 12-961 2 conclude that it is in the pubic interest to modify the license for Amateur Radio Service Station WH6DWF by changing the authorized operating privileges from General Class to Technician Class. 5. Conclusion. For the reasons stated above, we conclude that the grant of General Class amateur radio operator privileges to Wilson was improper. Accordingly, we modify the amateur service operator license for amateur station WH6DWF by replacing General Class operator privileges with Technician Class operator privileges. 6. ACCORDINGLY, IT IS ORDERED, pursuant to Sections 4(i) and 316(a) of the Communications Act of 1934, 47 U.S.C. §§ 154(i), 316(a), and Section 1.87 of the Commission's Rules, 47 C.F.R. § 1.87, that the operator license of Todd Wilson for amateur service Station WH6DWF BE MODIFIED by replacing General Class operator privileges with Technician Class operator privileges. 7. IT IS FURTHER ORDERED that this Order of Modification shall be sent by certified mail, return receipt requested, to Mr. Todd Wilson, P.O. Box 8806, Honolulu, Hawaii 96830. 8. This action is taken under delegated authority pursuant to Sections 0.131 and 0.331 of the Commission’s Rules, 47 C.F.R. §§ 0.131, 0.331.
