Bradley FilmOn TV 1920 E Maple El Segundo, CA 90245 RE: Call Sign E130003 File No.: SES-LIC-20130102-00001 Dear Mr. Bradley: On January 2, 2013, FilmOn TV filed the above-captioned application for an authorization to operate a new Fixed-Satellite Service earth station using two 2.4-meter antennas: one in the C- band (3700-4200 MHz and 5925-6425 MHz), and the other in the Ku-band (11.7-12.2 GHz and 14.0-14.5 GHz). For the reason stated below, we dismiss the application as defective without prejudice to refiling.1 Section 25.112 of the Commission’s rules requires the Commission to return, as unacceptable for filing, any earth station application that is not substantially complete, that contains internal inconsistencies, or that does not substantially comply with the Commission’s rules. FilmOn TV’s application contains internal inconsistencies, which renders it unacceptable and subject to dismissal.2 In response to items E43/44 of Schedule B, FilmOn TV lists the frequency band 5925-5929 MHz for emission designators 15M2G7W, 18M2G7W, and 36M2G7W (E47). The carrier bandwidth for each designator is wider than the proposed frequency range, which is only four megahertz wide. The frequency coordination report that was submitted with the application also contains the internal inconsistency between the proposed individual carrier bandwidths and the total amount of spectrum to be utilized. Please correct these internal inconsistencies if refiling. Accordingly, pursuant to Section 25.112(a)(1) and Section 0.261 of the Commission’s rules on delegation of authority, 47 C.F.R. § 25.112(a)(1) and 47 C.F.R. § 0.261, we dismiss FilmOn TV’s application without prejudice to refiling.
