Federal Communications Commission DA 13-1704 Federal Communications Commission Washington, D.C. 20554 August 2, 2013 John Goodman Corporate Vice President and Chief Legal Officer Purple Communications, Inc. 595 Menlo Drive Rocklin, CA 95765 Re: Telecommunications Relay Services and Speech-to-Speech Services for Individuals with Hearing and Speech Disabilities, CG Docket No. 03-123 Dear Mr. Goodman: On July 8, 2013, Purple Communications, Inc., requested on an emergency basis, a limited, 120- day waiver of the Commission's speed-of-answer requirements1 with respect to Purple's Internet protocol relay service (IP Relay).2 Purple has asserted that such a waiver is necessary in light of traffic surges resulting from the recent decisions of several IP Relay providers to cease providing service, including, most recently, the cessation of service by Sorenson Communications, Inc., effective July 31, 2013. Given the particular circumstances of this waiver request, we find it in the public interest to grant a short-term waiver to allow Purple some temporary flexibility in its operations while we give full consideration to its waiver request. Therefore, at this time we grant Purple a limited waiver of section 64.604(b)(2) of the Commission’s rules, applicable to Purple’s provision of IP Relay during the period from August 1 through August 12, 2013. Nothing in this ruling should be interpreted as an indication of intent to either grant or deny Purple’s broader request. A further decision will be issued shortly with respect to the other periods for which Purple has requested a waiver. Accordingly, IT IS ORDERED that, pursuant to the authority granted by Sections 1, 4(i), 4(j), 5, and 225 of the Communications Act of 1934, as amended, 47 U.S.C. §§ 151, 154(i), 154(j), 155 and 225, and pursuant to the authority delegated in Sections 0.141, 0.361, and 1.3 of the Commission’s rules, 47 C.F.R. §§ 0.141, 0.361, 1.3, Purple’s request for waiver is GRANTED to the extent indicated herein. This Order shall be effective upon release, in accordance with Section 1.4(b)(2) of the Commission’s rules, 47 C.F.R. § 1.4(b)(2).
