Federal Communications Commission DA 13-1705 Federal Communications Commission Washington, D.C. 20554 August 2, 2013 Scott R. Freiermuth Counsel - Government Affairs Sprint Corporation 6450 Sprint Parkway Overland Park, KS 66251 Re: Telecommunications Relay Services and Speech-to-Speech Services for Individuals with Hearing and Speech Disabilities, CG Docket No. 03-123 Dear Mr. Freiermuth: On July 16, 2013, Sprint Corporation requested a limited, four-month waiver of the Commission's speed-of-answer requirements1 with respect to Sprint's Internet protocol relay service (IP Relay).2 Sprint has asserted that such a waiver is necessary in light of traffic surges resulting from the recent cessation of service by Sorenson Communications, Inc., effective July 31, 2013. Given the particular circumstances of this waiver request, we find it in the public interest to grant a short-term waiver to allow Sprint some temporary flexibility in its operations while we give full consideration to its waiver request. Therefore, at this time we grant Sprint a limited waiver of section 64.604(b)(2) of the Commission’s rules, applicable to Sprint’s provision of IP Relay during the period from August 1 through August 12, 2013. Nothing in this ruling should be interpreted as an indication of intent to either grant or deny Sprint’s broader request. A further decision will be issued shortly with respect to the other periods for which Sprint has requested a waiver. Accordingly, IT IS ORDERED that, pursuant to the authority granted by Sections 1, 4(i), 4(j), 5, and 225 of the Communications Act of 1934, as amended, 47 U.S.C. §§ 151, 154(i), 154(j), 155 and 225, and pursuant to the authority delegated in Sections 0.141, 0.361, and 1.3 of the Commission’s rules, 47 C.F.R. §§ 0.141, 0.361, 1.3, Sprint’s request for waiver is GRANTED to the extent indicated herein. This Order shall be effective upon release, in accordance with Section 1.4(b)(2) of the Commission’s rules, 47 C.F.R. § 1.4(b)(2). If you have any questions, please contact Bob Aldrich, Consumer and Governmental Affairs Bureau, FCC, at (202) 418-0996 and robert.aldrich@fcc.gov. Sincerely, Kris Anne Monteith Acting Chief Consumer and Governmental Affairs Bureau 1 47 C.F.R. § 64.604(b)(2). 2 See Sprint Communications, Inc., Petition for Temporary Limited Waiver (filed July 16, 2013).
