Federal Communications Commission Washington, D.C. 20554 August 13, 2013 DA 13-1749 Mr. Robb Murphy d/b/a GRRM Productions 414 2nd Street Unit #333 Hermosa Beach, CA 90254 robb@flyingcowsat.com Call Sign: E130121 File No.: SES-LIC-20130703-00569 Dear Mr. Murphy: On July 3, 2013, you filed above-captioned application for a new license to operate a Temporary-Fixed earth station in the Ku-Band.1 Pursuant to Section 25.112(a)(1) of the Commission’s rules, 47 C.F.R. § 25.112(a)(1), we dismiss the application as defective without prejudice to re-filing.2 Section 25.112 of the Commission’s rules, 47 C.F.R. § 25.112, requires the Commission to return, as unacceptable for filing, any earth station application that is not substantially complete, contains internal inconsistencies, or does not substantially comply with the Commission’s rules. For the reasons stated below, the application is internally inconsistent, which renders it unacceptable and subject to dismissal. Specifically, the application lists the Total EIRP for all carriers in item E40 of Schedule B to Form 312 as 70.3 dBW. This value is inconsistent with the value of 125 Watts provided for the Total input power at antenna flange in item E38. Based on a Total input power at antenna flange of 125 Watts, we calculate that the Total EIRP for all carriers should be 66.86 dBW, not 70.3 dBW.3 1 We note that the application was filed in the name of Robb Murphy, with Flying Cow Satellite Services, LLC, as a point of contact. In the event the application is re-filed, please confirm whether the licensee is intended to be Robb Murphy, or whether the intended licensee is, in fact, Flying Cow Satellite Services, LLC (with Robb Murphy as a point of contact). 2 If you elect to re-file an application in which the deficiencies identified in this letter have been corrected, but is otherwise identical to the one dismissed, you need not pay an application fee. See 47 C.F.R. § 1.1111(d). 3 Total EIRP for all carriers (dBW) = 10 log10 (total input power at antenna flange) + antenna transmit gain. Therefore, Total EIRP for all carriers (dBW) = 10 log10 (125W) + 45.9 dBi = 66.86 dBW. We also note that if the application is re-filed with a corrected Total EIRP for all carriers, items E48 and E49 of Schedule B must be corrected to correspond with the correct Total EIRP for all carriers. Federal Communications Commission DA 13-1749 2 Accordingly, pursuant to Section 25.112(a)(1) of the Commission’s rules, 47 C.F.R. § 25.112(a)(1), and Section 0.261 of the Commission’s rules on delegations of authority, 47 C.F.R. § 0.261, we dismiss the application without prejudice to re-filing. Sincerely, Paul E. Blais Chief, Systems Analysis Branch Satellite Division International Bureau
