PUBLIC NOTICE Federal Communications Commission 445 12th St., S.W. Washington, D.C. 20554 News Media Information 202 / 418-0500 Internet: http://www.fcc.gov TTY: 1-888-835-5322 DA 13-1858 September 5, 2013 NOTICE CONCERNING EX PARTE STATUS OF INFORMATION SUBMITTED TO THE COMMUNICATIONS SECURITY, RELIABILITY, AND INTEROPERABILITY COUNCIL The Federal Communications Commission (FCC or Commission) recently announced the first meeting of the fourth iteration of the Communications Security, Reliability, and Interoperability Council (CSRIC), to be held on Thursday, September 12, 2013.1 The CSRIC is a federal advisory committee that will provide recommendations to the Commission regarding best practices and actions the Commission may take to ensure the security, reliability, and resiliency of the Nation’s communications systems. Under the Federal Advisory Committee Act, the Commission is responsible for oversight of the CSRIC, including its informal working groups.2 As a result, FCC staff may participate in meetings or other activities held by both the CSRIC and its informal working groups. In light of this, we are announcing that, pursuant to section 1.1200(a) of the Commission’s rules, 47 C.F.R. § 1.1200(a), presentations to the CSRIC, including its working groups, will be treated as exempt presentations for ex parte purposes. This treatment is appropriate since presentations to the Council, like comments on a Notice of Inquiry, will not directly result in the promulgation of new rules.3 We recognize, however, that issues that may be addressed by the Council are the subject of a number of pending FCC proceedings.4 The Commission will not rely in these proceedings on any information submitted to the Council, or to any of its subcommittees or working groups, unless that information is first placed in the record of the relevant proceeding. 1 FCC Announces Meeting of the Communications Security, Reliability, and Interoperability Council Scheduled for September 12, 2013 at FCC Headquarters, Public Notice, DA 13-1762, rel.
