On July 18, 2013, NBC Telemundo filed the above minor amendment to correct the antenna height. We dismiss the above-captioned applications as defective without prejudice to re-filing.1 Section 25.112(a)(1) of the Commission’s rules, 47 C.F.R. § 25.112(a)(1), requires the Commission to return, as unacceptable for filing, any earth station application that is not substantially complete, that contains internal inconsistencies, or that does not substantially comply with the Commission’s rules. We find that NBC Telemundo’s application is internally inconsistent for the reason discussed below. NBC Telemundo lists the EIRP density in item E49 of Schedule B for emission carrier 36M0G7W as 80.13 dBW/4kHz. Based on other information provided by NBC Telemundo elsewhere in its application, we calculate that EIRP density should be 1.0 dBW/4kHz. 2 Thus, the values provided in the application are inconsistent. 1 If NBC Telemundo re-files an application identical to the one dismissed, with the exception of supplying the corrected information, it need not pay an application fee. See 47 C.F.R. § 1.1111(d). 2 NBC Telemundo states in items E48 and E47of the Schedule B that the EIRP per carrier is 40.59 dBW and the carrier is 36MHz (75.6dB) wide respectively. Accordingly, we convert the Carrier EIRP to Carrier EIRP Density/4kHz as follows: 40.59 dBW/carrier - 75.6 dB/carrier + 36 dB/4kHz, which equals a Federal Communications Commission DA 13-1868 2 Accordingly, pursuant to Section 25.112(a)(1) of the Commission’s rules, 47 C.F.R. § 25.112(a)(1), and Section 0.261(a)(4) of the Commission’s rules on delegations of authority, 47 C.F.R. § 0.261(a)(4), we dismiss the above-captioned applications without prejudice to re-filing.
