Washington, D.C. 20554 News Media Information 202 / 418-0500 Internet: http://www.fcc.gov TTY: 1-888-835-5322 DA 13-201 Released: February 13, 2013 FCC SEEKS NOMINATIONS FOR MUNICIPAL AND TRIBAL REPRESENTATIVES ON THE INTERGOVERNMENTAL ADVISORY COMMITTEE With this Public Notice, the Federal Communications Commission (Commission) seeks nominations to replace a municipal official member and a Tribal member on the Commission’s Intergovernmental Advisory Committee (IAC). 1 The IAC, comprised of 15 representatives from local, state, and Tribal governments, advises the Commission on a range of telecommunication issues for which their governments explicitly or inherently share responsibility or administration with the Commission.2 On December 4, 2009, the Commission reauthorized the IAC and on November 4, 2011, it announced the members of the 2011-2013 committee.3 The term of operations of the reauthorized IAC is two years, with an option for another two year term.4 The current IAC term commenced with its first meeting on December 2, 2011 and will conclude in December 2013.5 One of the four municipal representatives and one of the three Tribal representatives are no longer members of the IAC. We therefore seek nominations for a fourth elected municipal official representative and a third elected or appointed Tribal representative to replace the departed members. IAC MISSION The mission of the IAC is to make recommendations to the Commission on the many telecommunications issues affecting local, state and Tribal governments that are within the jurisdiction of the Commission. See also Chairman Genachowski Announces Intergovernmental Advisory Committee Members, Public Notice, 26 FCC Rcd 15648 (2011). 2IAC MEMBERSHIP Pursuant to Section 0.701(b) of the Commission rules, the IAC shall include four elected municipal officials (city mayor or city council member) as well as three elected or appointed Native American Tribal representatives, and this Public Notice is issued to fill one vacancy in each membership category.6 Further, to ensure compliance with section 204(b) of the Unfunded Mandates Reform Act of 1995 (UMRA),7 which provides for an exemption from the Federal Advisory Committee Act (FACA) for certain intergovernmental groups, any nomination of a Tribal member must be supported by a designation letter from an elected officer of that Tribal government if the nominee does not hold an elected position.8 Our compliance with the requirements of section 204(b) of UMRA ensures that the IAC can continue to operate with the informality and flexibility that have proven effective in the past and that inhere in the IAC’s FACA-exempt status. A nominee must be willing to commit to serve for the full term that the IAC is authorized through December 2013 and should expect to attend four (4) one day meetings per year in Washington, D.C. at the applicant’s own expense.9 Members who fail to “attend a minimum of 50% of the IAC’s yearly meetings . . . may be removed by the Chairman of the IAC for failure to comply with this requirement.”10 Members will also have an initial and continuing obligation to disclose any interests in, or connections to, persons or entities who are, or will be, regulated by, or who have interests before, the Commission. PROCEDURES AND DEADLINE FOR MEMBERSHIP APPLICATIONS Nominees for the IAC municipal and Tribal membership positions must submit their applications: (1) online via email; and/or (2) hardcopy via mail. Applications must be submitted no later than thirty (30) calendar days after the release date of this Public Notice. Applications submitted via email must be sent to iac@fcc.gov.
