The Audio Division has before it: (1) a Notice of Proposed Rule Making (“Notice”) issued in response to a Petition for Rule Making (“Petition”) filed by Cochise Media Licenses, LLC (“Petitioner”);1 and (2) supporting comments filed by the Petitioner. For the reasons discussed below, we grant the Petition. 2. Background. The Notice proposes to amend the FM Table of Allotments, Section 73.202(b) of the Commission’s rules, by allotting FM Channel 229C3 at Dove Creek, Colorado, as the community’s first local service. Petitioner filed comments supporting the allotment change proposed in the Notice. No other comments were received. 3. Discussion. We believe that the proposed allotment will serve the public interest, because it would provide a first local service to Dove Creek, Colorado. FM Channel 229C3 can be allotted at Dove Creek, Colorado. The proposed allotment complies with the Commission’s spacing requirements at reference coordinates 37-48-05 NL and 108-59-33 WL. 4. The Commission will send a copy of this Report and Order in a report to Congress and the Government Accountability Office pursuant to the Congressional Review Act.2 5. Accordingly, IT IS ORDERED, That effective April 15, 2013, the FM Table of Allotments, 47 C.F.R. Section 73.202(b), IS AMENDED as follows: Community Channel Number Dove Creek, Colorado 229C3 6. The window period for filing applications for FM Channel 229C3 at Dove Creek, Colorado, will not be opened at this time.
