Pursuant to Section 25.112(a) of the Commission’s rules, 47 C.F.R. § 25.112(a)(1), we dismiss the application as defective without prejudice to refiling.1 Section 25.112(a) of the Commission’s rules requires the Commission to return, as unacceptable for filing, any application that is not substantially complete, that contains internal inconsistencies, or that does not substantially comply with the Commission’s rules2. For the reasons set forth below, we find the application of IHLAS HABER AJANSI IHA unacceptable for filing. IHLAS HABER AJANSI IHA states in item E49 of Schedule B, that the equivalent isotropically radiated power (EIRP) density per carrier will be -12.0 dBW/4kHz for emission designator 8M00G7F. This value is inconsistent with the calculation of the value based on information provided by IHLAS HABER AJANSI IHA in other items of Schedule B, which indicates that value should be 23.98 dBW/4kHz.3 IHLAS HABER AJANSI IHA’s response to question 20 of FCC Form 312 indicates that it proposes to provide both mobile-satellite services and fixed-satellite service. Fixed Satellite.” Accordingly, pursuant to Section 25.112(a)(1) of the Commission’s rules, 47 C.F.R. § 25.112(a)(2), and Section 0.261 of the Commission’s rules on delegations of authority, 47 C.F.R. § 0.261, we dismiss the application, without prejudice to refiling.
