The NANC is responsible for making recommendations to the Commission to assist in the selection of a vendor(s) to serve as the LNPA. Only those members of the NANC or its subgroups that have executed non-disclosure agreements have access to this confidential procurement. This procurement information constitutes trade secrets and privileged or confidential commercial or financial information for which the Sunshine Act authorizes the closure of meetings under section 552b(c) of title 5, United States Code. Therefore, the closure of the meeting scheduled for March 26, 2014 is appropriate under section 10(d) of FACA, which provides for an exception to FACA's open meetings requirement for closures warranted under the Sunshine Act, S U.S.C. §552b(c). Because no matters other than the LNPA procurement will be addressed at this meeting, the entire meeting is subject to closure. Accordingly, the request for approval to close this meeting in its entirety is granted.
