Federal Communications Commission Washington, D.C. 20554 March 31, 2014 DA 14-430 Mr. David Heximer AIRTAP COMMUNICATIONS, LLC 220 Burgess Drive Suite 4 Broussard, LA 70518 File No.: SES-LIC-20131113-00979 Call Sign: E130225 Dear Mr. Heximer: On November 13, 2013, AIRTAP COMMUNICATIONS, LLC (AIRTAP) filed the above- captioned application seeking blanket authorization for 300 Seatel model USAT30 antennas operating as Earth Station on Vessels in the 11.7-12.2 GHz (space-to-Earth) and 14.0-14.5 GHz (Earth-to-space) frequency bands. AIRTAP requests “ALSAT” as a point of communication for these antennas. Pursuant to Section 25.112(a)(1) of the Commission’s rules, 47 C.F.R. § 25.112(a)(1), we dismiss the application, without prejudice to re-filing.1 Section 25.112 of the Commission’s rules, 47 C.F.R. § 25.112, requires the Commission to return, as unacceptable for filing, any earth station application that is not substantially complete, contains internal inconsistencies, or does not substantially comply with the Commission’s rules. For the reasons stated below, AIRTAP’s application is unacceptable and subject to dismissal. • AIRTAP did not submit a radiation hazard study, as required by the text included in item 28 of Form 312 and Section 1.1307(b) of the Commission's rules, 47 C.F.R.§1.1307(b). • AIRTAP responded “no” to item E15 of Schedule B, which allows applicants to certify that antennas comply with Section 25.209 of the Commission’s rules, 47 C.F.R. § 25.209. Applications that do not comply with Section 25.209 must submit showings in compliance with Section 25.222(a)(i) of the Commission’s rules, 47 C.F.R. § 25.222(a)(i). AIRTAP did not provide these showings. • AIRTAP incorrectly calculated the Maximum EIRP Density per Carrier for emission carrier 686KG7W in Schedule B. AIRTRAP lists the density per carrier as 18.06 dBW/4kHz. As noted below, we calculate it to be 22.04 dBW/4kHz, based upon the Carrier EIRP value of 44.4 dBW provided by AIRTAP in item E48.2 1 If AIRTAP re-files an application in which the deficiencies identified in this letter have been corrected, but is otherwise identical to the one dismissed, it need not pay an application fee. In this instance, 44.4dB/Carrier – (10*log(686,000)dB/Hz )+36dB/4kHz = 22.04dBW/4kHz Federal Communications Commission DA 14-430 2 • The input power density of -17.64 dBW/4kHz for emission 686KG7W exceeds the antenna manufacture’s input power density limit of -21.6 dBW/4kHz, and therefore does not comply with Section 25.222(a)(1)(i) of the Commission’s rules, 47 C.F.R. § 25.222(a)(i). • Because AIRTAP’s application does not demonstrate compliance with Sections 25.222(a)(1)(i) and 25.222(a)(1)(iii) of the Commission’s rules, AIRTAP cannot request ALSAT as a point of communication. See 47 C.F.R. Section 25.222(b)(7). Accordingly, pursuant to Section 25.112(a)(1) of the Commission’s rules, 47 C.F.R. § 25.112(a)(1), and Section 0.261 of the Commission’s rules on delegations of authority, 47 C.F.R. § 0.261, we dismiss AIRTAP’s application, without prejudice to re-filing.
