The Audio Division has before it the “Request to Dismiss,” submitted on behalf of Reynolds Technical Associates (“RTA”) on November 4, 2013. RTA requests dismissal of its June 25, 2007, Petition for Partial Reconsideration of the Report and Order in this proceeding.1 On November 7, 2013, Spanish Peaks Broadcasting, Inc. ("SPB") filed a “Request To Dismiss Comments in Support of Petition for Partial Reconsideration” (“SPB Comments”) filed on September 1, 2009. For reasons discussed below, we dismiss the Petition for Partial Reconsideration and the SBP Comments. 2. RTA states that it is no longer interested in pursuing its Petition for Partial Reconsideration. In compliance with Section 1.420(j) of the Commission’s Rules,2 RTA certifies that there is no agreement and no consideration received or promised in exchange for such withdrawal. 3. SPB states that it is no longer interested in the proceeding. Pursuant to Section 1.420(j) of the Commission's Rules,3 SPB states that it has not entered into any agreement and that it has not received any consideration or has it been promised any consideration in exchange for the withdrawal of SPB Comments. 4. Accordingly, IT IS ORDERED, That the “Request to Dismiss” submitted by Reynolds Technical Associates, IS GRANTED. 5.
