Federal Communications Commission Washington, D.C. 20554 November 23, 2015 DA 15-1346 Mr. Daryl White Denali 20020, LLC 66 C Teleport Drive, Brewster, WA 98812 TOCC@usei-teleport.com Call Sign: E150116 File No.: SES-LIC-20150915-00588 Dear Mr. White: On September 15, 2015, Denali 20020, LLC (“Denali 20020”) filed the above- captioned application for a license to operate a fixed earth station with (1) Intelsat 23 (S2831) at 53 degrees W.L.; (2) Intelsat 25 (S2804) at 31.5 degrees W.L.; and (3) the “Permitted Space Station List” satellites1 in the 10.95-11.2 GHz and 11.45-12.2 GHz (space-to-Earth), and 14.0- 14.5 GHz (Earth-to-space) frequency bands. Pursuant to Section 25.112(a)(1) of the Commission's rules, 47 C.F.R. § 25.112(a)(1), we dismiss the application as defective without prejudice to re-filing.2 Section 25.112(a) of the Commission’s rules requires the Commission to return, as unacceptable for filing, any earth station application that is not substantially complete, contains internal inconsistencies, or does not substantially comply with the Commission’s rules.3 For the reasons set forth below, we find Denali 20020’s application is unacceptable for filing. Specifically: · Intelsat 23 (S2831) and Intelsat 25 (S2804) are not authorized to operate in 10.95- 11.2 GHz frequency band, as you have requested. · The “Permitted Space Station List” points of communication are only authorized for operations in “conventional” frequency bands.4 Therefore, your request to communicate with Permitted List satellites in the 10.95-11.2 GHz and 11.45-12.2 GHz frequency bands is inconsistent with the Commission’s rules. 1 See http://transition.fcc.gov/ib/sd/se/permitted.html. 2 If Denali 20020 re-files an application identical to the one dismissed, with the exception of supplying the corrected information, it need not pay an application fee.
