Federal Communications Commission Washington, D.C. 20554 August 26, 2015 DA 15-960 Ms. Joanne Greet Universal Space Network, Inc. Suite A Horsham, PA 19044 jgreet@uspacenet.com Call Sign: E140105 File Nos.: SES-LFS-20141015-00799, SES-AMD-20141215-00894 Dear Ms. Greet: On October 15, 2014, Universal Space Network, Inc. (USN) filed the above-captioned application seeking an authorization to operate a receive-only fixed earth station in North Pole, Alaska, to receive signals from the PROBA-V satellite, operated by the European Space Agency (ESA), using the center frequency of 8090.0 MHz (space-to-Earth). For the reasons discussed below, we dismiss the application as defective, without prejudice to re-filing.1 Section 25.112 of the Commission’s rules, 47 C.F.R. § 25.112, requires the Commission to return, as unacceptable for filing, any earth station application that is not substantially complete, contains internal inconsistencies, or does not substantially comply with the Commission’s rules. Sections 25.131(j)(1) and 25.137(b) of the Commission’s rules, 47 C.F.R. §§ 25.131(j)(1) and 25.137(b), require submission of information concerning the PROBA-V satellite, including, as specified in Section 25.114(d)(14) of the Commission rules, 47 C.F.R. § 25.114(d)(14), information concerning the design and operational strategies that have been or will be used to mitigate orbital debris. USN has already provided some of this information;2 however the application remains incomplete with respect to several relevant requirements. In particular, the following information is required: · A statement confirming that the space station operator has assessed and limited the amount of debris released in a planned manner during normal operations. 47 C.F.R. § 25.114(d)(14)(i). · A statement that the space station operator has assessed and limited the probability of the space station becoming a source of debris by collisions with large debris or other operational space stations. 47 C.F.R. § 25.114(d)(14)(iii). In addition, please address the anticipated risk of a debris generating collision between PROBA-V and other objects over the orbital lifetime of the satellite. Finally, to the extent there is any additional information supporting departure from the 25 year post- mission disposal guideline, please provide that information. 1 If USN files an application in which the deficiencies identified in this letter have been corrected, but is otherwise identical to the one dismissed, it need not pay an application fee. See 47 C.F.R. § 1.1111(d). 2 See Letter from Paul E. Blais, Chief, Systems Analysis Branch, Satellite Division, International Bureau, to Ms. Joanne Greet, Universal Space Network, Inc., dated April 7, 2015. In response to this request, USN submitted a number of documents. See e-mail from Ms. Joanne Greet, Universal Space Network, Inc., to Paul E. Blais, Chief, Systems Analysis Branch, Satellite Division, International Bureau, dated April 15, 2015, available in IBFS File No. SES-LFS- 20141015-00799. Federal Communications Commission DA 15-960 2 Accordingly, pursuant to Section 25.112(a)(1) of the Commission’s rules, 47 C.F.R. § 25.112(a)(1), and Section 0.261 of the Commission’s rules on delegations of authority, 47 C.F.R. § 0.261, we dismiss the application of USN without prejudice to re-filing. Sincerely, Paul E. Blais Chief, Systems Analysis Branch Satellite Division International Bureau
