On October 24, 2017, the following parties filed a request for an extension of the reply comment period in the above-captioned proceeding: Enterprise Wireless Alliance; pdvWireless, Inc.; Southern Company Services, Inc.; Utilities Technology Council; and Sensus USA Inc. (Petitioners).1 For the reasons set forth below, we deny the motion. 2. On August 4, 2017, the Commission released a Notice of Inquiry in this proceeding, and initially set deadlines of September 18, 2017, for comments and October 18, 2017, for reply comments.2 On September 8, 2017, in response to a motion from Florida Power & Light Co. and the Edison Electric Institute, the Wireless Telecommunications Bureau extended the comment and reply comment dates by two weeks (to October 2, 2017, and November 1, 2017, respectively) in order to accommodate parties assisting in the recovery efforts and others that encountered disruption because of the unusual circumstances arising from Hurricanes Harvey and Irma.3 3. On October 24, 2017, Petitioners requested that the reply comment period be extended an additional six weeks, to December 13, 2017. They state that an extension of time would “provide a further opportunity for continued constructive discussions among parties that would be most directly affected by a realignment of the 896-901/935-940 MHz band . . . [and] give the Petitioners an opportunity to resolve and/or narrow contested issues on the record in the proceeding, thereby helping to accelerate its ultimate disposition.”4 3. Federal Communications Commission DA 17-1056 2 While we encourage interested parties to engage in constructive discussions regarding the issues raised in this proceeding, we note that the parties may inform the Commission of any agreement or consensus reached after the reply comment deadline in ex parte filings,6 as the docket in this proceeding does not close when the comment cycle has ended.7 Moreover, we note that the reply comment period in this proceeding already was extended once. We therefore deny the motion. 4. Accordingly, IT IS ORDERED that, pursuant to sections 4(i), 4(j), and 5(c) of the Communications Act of 1934, as amended, 47 U.S.C. §§ 154(i), 154(j), and 155(c), and section 1.46 of the Commission’s rules, 47 CFR § 1.46, the Motion for Extension of Time filed by the Enterprise Wireless Alliance; pdvWireless, Inc.; Southern Company Services, Inc.; Utilities Technology Council; and Sensus USA Inc. on October 24, 2017, IS DENIED. 5. This action is taken under delegated authority pursuant to sections 0.131 and 0.331 of the Commission’s rules, 47 CFR §§ 0.131, 0.331.
