On January 6, 2017, Public Knowledge and Open Technology Institute (together, Petitioners) filed a motion to extend the date for oppositions to petitions for reconsideration from January 17, 2017 to January 31, 2017 and the date for replies to oppositions to petitions for reconsideration from January 27, 2017 to February 10, 2017. 2 Petitioners assert, “Given the diversity and complexity of issues raised by the 13 Petitions, it would be appropriate for the Commission to grant an extension of time to ensure that it has before it a robust and fully developed record upon which to rely as it reviews these Petitions.” 3 Petitioners also claim additional time is needed because there were holidays and the Consumer Electronics Show during the time for preparing oppositions. 4 Petitioners note that they notified all parties who filed petitions for reconsideration of their intent to file the Motion and represent that NCTA – The Internet & Television Association, T-Mobile USA, Inc., ViaSat, Inc., Competitive Carriers Association, 1 Use of Spectrum Bands Above 24 GHz for Mobile Radio Services, Report and Order and Further Notice of Proposed Rulemaking, 31 FCC Rcd 8014 (2016). 2 Motion for Extension of Time (Corrected Version), Public Knowledge and Open Technology Institute (filed Jan. 6, 2017) (Motion). 3 Id. at 2. 4 Id. Echostar Satellite Operating Corporation, Nextlink Wireless, LLC, and The Boeing Company have no objection to grant of the Motion. 5 It is the general policy of the Commission that extensions of time shall not be routinely granted. 6 However, under these circumstances, we agree that an extension of time to file oppositions and replies is warranted to ensure that the Commission obtains a complete and thorough record in response to the petitions for reconsideration. The petitions raise a wide variety of issues, many of which are complex and technical in nature. We conclude that an extension of time is warranted to enable interested parties sufficient opportunity to review and to respond to the complex issues raised by the petitions for reconsideration. Accordingly, pursuant to Section 4(i) of the Communications Act of 1934, as amended, 7 and Section 1.46 of the Commission's rules, 8 we extend the deadline for filing oppositions to petitions for reconsideration until January 31, 2017. We also extend the deadline for replies to oppositions to petitions for reconsideration until February 10, 2017. On January 9, 2017, the Telecommunications Industry Association (TIA) filed comments on the Motion stating that it had no objection to the Motion so long as the deadline for replies is extended to February 24, 2017.
