On August 3, 2015, Verizon Virginia, LLC and Verizon South, Inc. (collectively, Verizon) filed a pole attachment complaint 1 in the above-captioned proceeding against Dominion Virginia Power (Dominion) pursuant to Section 224 of the Communications Act, as amended, and Commission rules 1.1401-1.1424. 2 On September 27, 2017, Verizon and Dominion filed a Joint Motion stating that the parties have settled the dispute giving rise to the Complaint and seeking “dismissal with prejudice of the Complaint as to all claims and defenses asserted therein.” 3 We are satisfied that granting the Joint Motion will serve the public interest by promoting the private resolution of disputes, eliminating the need for further litigation, and conserving the resources of the parties and the Commission. 2. Accordingly, IT IS ORDERED, pursuant to the authority contained in Sections 4(i), 4(j), and 224 of the Communications Act, 47 U.S.C. §§ 154(i), 154(j), and 224, and Sections 0.111, 0.311, and 1.1401-1.1424 of the Commission’s rules, 47 CFR §§ 0.111, 0.311, and 1.1401-1.1424, that the Joint Motion is GRANTED and this proceeding is DISMISSED WITH PREJUDICE.
