On November 7, 2008, the Commission released a Report and Order in the above-captioned docket. Digital Television Distributed Transmission System Technologies, Report and Order, 23 FCC Rcd 16731 (2008) (facilitating the use of distributed transmission system technologies in the digital television service pursuant to the Deficit Reduction Act of 2005) (Report and Order). See also Deficit Reduction Act of 2005, Pub. L. No. 109-171, 120 Stat. 4 (2006). Title III of the Deficit Reduction Act of 2005 is the DTV Act (DTV Act). The DTV Act is codified at 47 U.S.C. §§ 309(j)(14)(A) and 337(e). On December 31, 2008, the Association for Maximum Service Television, Inc. (now part of the National Association of Broadcasters) (NAB/MSTV) filed a Petition for Reconsideration of the Report and Order. Petition for Reconsideration of the Association for Maximum Service Television, Inc., MB Docket No. 05-312 (filed Dec 31, 2008). 2. Due to the passage of time, NAB/MSTV has agreed to withdraw its petition. Therefore, we are dismissing the petition without prejudice. 3. Accordingly, IT IS ORDERED that the NAB/MSTV Petition for Reconsideration filed in this docket IS DISMISSED without prejudice. 4.
