DA 19-1293 2 December 18, 2019 NOTICE OF EFFECTIVE DATE OF LEASED ACCESS RULES REQUIRING OMB APPROVAL MB Docket Nos. 07-42 and 17-105 On June 6, 2019, the Commission adopted an order updating its leased access rules as part of the its Modernization of Media Regulation Initiative. Leased Commercial Access; Modernization of Media Regulation Initiative, Report and Order and Second Further Notice of Proposed Rulemaking, 34 FCC Rcd 4934 (2019) (Leased Access Order). Those rules became effective on July 22, 2019, except for the rules that require approval by the Office of Management and Budget (OMB). See Federal Communications Commission, 47 CFR Part 76, Leased Commercial Access; Modernization of Media Regulation Initiative, 84 FR 28761 (June 20, 2019). The rules that require OMB approval are sections 76.970(h) and 76.975(e). The information collection was submitted to OMB for review under 47 U.S.C. § 3507(d) and was approved by OMB on December 3, 2019. The Commission in the Leased Access Order stated that the rules containing new or modified information collection requirements will become effective after the Commission publishes a notice in the Federal Register announcing OMB approval and the relevant effective date. See Leased Access Order, 34 FCC Rcd at 4960, para. 59. The Commission has published this notice in the Federal Register, announcing an effective date of December 18, 2019. See Federal Communications Commission, 47 CFR Part 76, Leased Commercial Access; Modernization of Media Regulation Initiative, 84 FR 69342 (Dec. 18, 2019).
