On October 24, 2018, the Commission released a Report and Order in the above-captioned docket. Promoting Investment in the 3500-3700 MHz Band, Report and Order, GN Docket No. 17-258, FCC 18-149 (2018) (3.5 GHz Report and Order).
  The 3.5 GHz Report and Order was published in the Federal Register on December 7, 2018. Promoting Investment in the 3550-3700 MHz Band, 83 FR 63076 (Dec. 7, 2018) (to be codified at 47 CFR pt. 96).
  Pursuant to section 1.429 of the Commission’s rules, petitions for reconsideration are due on or before January 7, 2019. See 47 CFR § 1.429(d).


The Commission recently released a Public Notice regarding operations during a potential lapse in government funding. Impact of Potential Lapse in Funding on Commission Operations, Public Notice, DA 19-10 (Jan. 2, 2019).
  In that Notice, the Commission specified that “Commission staff will continue to perform ongoing work related to spectrum auction activities authorized by section 309(j) of the Communications Act . . . .” Id. at 2.
  It also “stress[ed] that filings related to spectrum auction activities authorized by section 309(j) . . . can and must be made by or before the previously announced deadlines.” Id. at 3.
  Therefore, the deadline for petitions for reconsideration of the 3.5 GHz Report and Order remains Monday, January 7, 2019.
