Federal Communications Commission DA 19-994 DA 19-994 Released: October 2, 2019 WIRELESS TELECOMMUNICATIONS BUREAU GRANTS 28 GHZ BAND UPPER MICROWAVE FLEXIBLE USE SERVICE LICENSES Auction No. 101 On January 31, 2019, the Federal Communications Commission (“Commission”) completed the auction of 28 GHz Upper Microwave Flexible Use Service (UMFUS) licenses (Auction 101), and announced the results on June 3, 2019. Auction of 28 GHz Upper Microwave Flexible Use Service Licenses for Next Generation Wireless Services Closes: Gross Winning Bid Amounts Announced For Auction 101, Public Notice, DA 19-23 (Jan. 31, 2019); Winning Bidders Announced for Auction of 28 GHz Upper Microwave Flexible Use Service Licenses (Auction 101), Public Notice, DA 19-484 (June 3, 2019) (Auction 101 Results PN). The 28 GHz band includes the frequencies 27.5-28.35 GHz. Under the limited information procedures established for Auction 101 and Auction 102 (24 GHz UMFUS licenses), certain detailed Auction 101 results data remained non-public until after the close of bidding in Auction 102. This auction, which was designated Auction 101, raised a total of $700,309,809 in net bids ($702,572,410 in gross bids), with 33 bidders winning a total of 2,965 licenses. “Gross bids” refers to the total amount of winning bids at the close of bidding and does not reflect any small business or rural service provider bidding credits claimed by eligible winning bidders that may be awarded after the auction. “Net bids” refers to the total amount of winning bids as adjusted for any small business or rural service provider bidding credits claimed by winning bidders. Some of the FCC long-form applications (FCC Form 601) of winning bidders were accepted for filing on June 5, 2019. Specifically, 28 FCC long-form applications (FCC Form 601) were accepted for filing on June 5, 2019. Wireless Telecommunications Bureau Announces that Applications for 28 GHz Band Flexible Use Licenses are Accepted for Filing, Public Notice, DA 19-517 (June 5, 2019) (Auction 101 First AFF PN). The Commission’s initial review of the long-form applications of other winning bidders in Auction 101 is ongoing. Subsequent public notices will announce the acceptance for filing and action taken on additional long-form applications. Upon further review and examination, the applications for the licenses listed in Attachment A have been found to be complete and in conformance with the Commission’s rules, and there are no petitions to deny or other requests pending that would prevent grant of these licenses. Review of applications appearing on the Auction 101 First AFF PN but not in Attachment A is ongoing. We find that granting the applications for the licenses listed in Attachment A serves the public interest, convenience, and necessity. Furthermore, the Commission has received full payment for the licenses listed in Attachment A, as required by Section 1.2109(a) of its rules. 47 CFR § 1.2109(a). Accordingly, by this Public Notice, we announce the grant of the licenses listed in Attachment A. We grant these licenses pursuant to Section 309(a) of the Communications Act, 47 U.S.C. § 309(a), and Sections 0.131 and 0.331 of the Commission’s rules, 47 C.F.R. §§ 0.131, 0.331, because it will serve the public interest, convenience, and necessity.
