CONSUMER AND GOVERNMENTAL AFFAIRS BUREAU ANNOUNCES COMMENT DATES FOR NOTICE OF PROPOSED RULEMAKING ON TCPA EXEMPTIONS

On October 1, 2020, the Commission released a Notice of Proposed Rulemaking that proposes measures to implement section 8 of the Pallone-Thune Telephone Robocall Abuse Criminal Enforcement and Deterrence Act and seeks comment on those proposals. Rules and Regulations Implementing the Telephone Consumer Protection Act of 1991, CG Docket No. 02-278, Notice of Proposed Rulemaking, FCC 20-140 (Oct. 1, 2020) (TCPA Exemptions NPRM); see also Pallone-Thune Telephone Robocall Abuse Criminal Enforcement and Deterrence Act, Pub. L. No. 116-105, 133 Stat. 3274, § 8 (2019) (TRACED Act); Telephone Consumer Protection Act of 1991, Pub. L. No. 102-243, 105 Stat. 2394 (1991), codified at 47 U.S.C. § 227 (TCPA).
  Specifically, the TRACED Act directs the Commission to ensure that any exemption the Commission has granted under section 227(b)(2)(B) of the TCPA for calls to residential lines or under section 227(b)(2)(C) for calls to wireless numbers includes certain requirements. TRACED Act, § 8.
  The TCPA Exemptions NPRM sets deadlines for filing comments and reply comments at 15 days and 25 days after publication in the Federal Register, respectively. TCPA Exemptions NPRM, para. 34.

On October 9, 2020, a summary of the TCPA Exemptions NPRM was published in the Federal Register. Federal Communications Commission, Rules and Regulations Implementing the Telephone Consumer Protection Act of 1991, Proposed Rule, 85 Fed. Reg. 64091 (Oct. 9, 2020) (TCPA Exemptions NPRM Summary). 
  Accordingly, comments are due on or before October 26, 2020, and reply comments are due on or before November 3, 2020.
