Federal Communications Commission DA 20-172 DA 20-172 Released: February 19, 2020 WIRELINE COMPETITION BUREAU ANNOUNCES OMB RENEWAL OF INFORMATION COLLECTION CONCERNING INMATE CALLING SERVICES WC Docket No. 12-375 By this Public Notice, the Wireline Competition Bureau (Bureau) announces that the Office of Management and Budget (OMB) has approved, for an additional three years, the information collection for inmate calling services (ICS). Federal Communications Commission, Information Collection Approved by the Office of Management and Budget, 85 Fed. Reg. 6947 (Feb. 6, 2020). This information collection implements Commission rules requiring every ICS provider to: (a) file annually a report providing certain data and other information regarding its ICS operations (Annual Report); 47 CFR § 64.6060(a). (b) file annually a certification that the data and other information in the provider’s Annual Report is accurate and that the provider is in compliance with the Commission’s ICS rules (Annual Certification); 47 CFR § 64.6060(b). and (c) disclose to consumers its ICS rates and ancillary service charges. 47 CFR § 64.6110. Pursuant to authority delegated by the Commission, 47 CFR §§ 0.91(f), 0.291(a); Rates for Interstate Inmate Calling Services, WC Docket No. 12-375, Second Report and Order and Third Further Notice of Proposed Rulemaking, 30 FCC Rcd 12763, 12892, para. 268 (2015). the Bureau revised the template and instructions for the Annual Report and the Annual Certification to clarify the instructions and make the Annual Reports easier to understand and analyze. The revisions also eliminate the portions of the Annual Report requiring the submission of information regarding “Video Calling Services.” See Global Tel*Link v. FCC, 866 F.3d 397, 415 (D.C. Cir. 2017), clarifying and amending, 859 F.3d 39, 58 (D.C. Cir. 2017). Specifically, these revisions, as approved by OMB, require each ICS provider to: · File the Annual Report using the electronic Excel template provided by the Commission, and in a machine-readable, manipulatable format; · Submit city and state information for each correctional facility the ICS provider serves; · Group the facilities it serves by underlying contract; · Separately report and explain its rates for debit/prepaid calls and collect calls; · Report fixed site commission payments by facility as well as by contract; and · Explain certain entries in its Annual Report, including any entry that omits requested information. The current templates and instructions for the Annual Report and Certification are available at https://www.fcc.gov/general/ics-data-collections. Each ICS provider shall use these templates and instructions in the Annual Report and Certification due April 1, 2020, and in subsequent Annual Reports and Certifications. See 47 CFR § 64.6060.
