In this Order, we cancel a Notice of Apparent Liability for a Forfeiture (NAL) CTC Media Group, File No. 0000087505, Memorandum Opinion and Order and Notice of Apparent Liability for Forfeiture, DA 19-1285 (MB Dec. 19., 2019). issued to CTC Media Group (CTC), licensee of FM translator station W282CQ, Bridgeton, North Carolina (Station), for apparently willfully violating section 73.3539 of the Commission’s rules by failing to timely file a license renewal application for the Station. 2. The NAL correctly noted that the deadline for filing applications for renewal of radio stations licensed to communities in North Carolina and South Carolina was August 1, 2019, the first day of the fourth full calendar month prior to the Station’s December 1, 2019, license expiration date. Id. at para. 2, citing 47 CFR §§ 73.1020, 73.3539(a). However, it overlooked the fact that the Commission first issued a license for the Station on August 12. 2019. Broadcast Actions, Public Notice, Report No. 49551, at 11 (MB Aug. 15, 2019). It was, therefore, impossible for CTC to file an application to renew the Station’s license by the August 1, 2019, deadline. Given this and the fact that CTC filed a renewal application prior to expiration of the Station’s license, we find that cancellation of the NAL is appropriate. 3. Accordingly, IT IS HEREBY ORDERED that, pursuant to Section 504(b) of the Communications Act of 1934, as amended, 47 U.S.C. § 504(b). and Sections 0.61, 0.283, and 1.80(f)(4) of the Commission’s rules, 47 CFR §§ 0.61, 0.283, 1.80(f)(4). the Notice of Apparent Liability for a Forfeiture (NAL/Acct. No. MB-201941410014) issued to CTC Media Group IS CANCELLED. 4. IT IS FURTHER ORDERED, that copies of this Order shall be sent by First Class and Certified Mail, Return Receipt Requested, to Michael Afflerbach, CTC Media Group, 1202 Pollock Street, New Bern, NC 28560.
