Ord. No. 10530 reprinted as amended in 3 U.S.C. § 301, and section 1.767 of the Commission's rules, 47 C.F.R. § 1.767, the following applications ARE GRANTED. These grants of authority are taken under section 0.261 of the Commission's rules, 47 C.F.R. § 0.261. Petitions for reconsideration under section 1.106 or applications for review under section 1.115 of the Commission's rules, 47 C.F.R. §§ 1.106, 1.115, may be filed within 30 days of the date of this public notice. These applications have been coordinated with the Department of State and other Executive Branch agencies pursuant to section 1.767(b) of the Commission's rules, 47 C.F.R. §1.767(b), and consistent with procedures established with the Department of State. This public notice serves as each cable landing licensee's Cable Landing License, or modification thereto, pursuant to the Cable Landing License Act and sections 1.767 and 1.768 of the Commission's rules. Cable landing licensees should review carefully the terms and conditions of their licenses. We grant the request for special temporary authority (STA) filed on August 17, 2021, by GU Holdings Inc. (GU Holdings) to allow the continued commercial operation of the portion of the Pacific Light Cable Network (PLCN) connecting the United States and Taiwan while the Commission considers the application for a cable landing license for the cable, SCL-LIC-20200827-00038. On April 8, 2020, the Commission granted GU Holdings an STA to operate the PLCN cable system on a commercial basis between the United States and Taiwan, conditioned on GU Holdings abiding by the commitments and undertakings contained in the April 7, 2020 Provisional National Security Agreement for Requested Special Temporary Authority between GU Holdings, and the Department of Justice, the Department of Homeland Security and the Department of Defense (April 7, 2020 Provisional NSA). See SCL-STA-20200402-00015. On September 22, 2020, the Commission granted an extension of that STA conditioned on GU Holdings abiding by the commitments and undertakings in the April 7, 2020 Provisional NSA and the September 18, 2020 Extension of Provisional National Security Agreement for Requested Special Temporary Authority. See SCL-STA-20200827-00037. On March 26, 2021, the Commission granted a further extension of that STA conditioned on GU Holdings abiding by the commitments and undertakings in the April 7, 2020 Provisional NSA and the March 18, 2021 Second Extension of the Provisional National Security Agreement for Requested Special Temporary Authority. See SCL-STA-20210308-00015. We grant the Petition to Adopt Conditions for Special Temporary Authority (Petition) filed in this proceeding on September 3, 2021, by the Department of Justice, with the concurrence of the Department of Defense and the Department of Homeland Security. Accordingly, we condition grant of the STA on GU Holdings abiding by the commitments and undertakings in the April 7, 2020 Provisional NSA and the September 3, 2021 Third Extension of the Provisional National Security Agreement for Requested Special Temporary Authority (Third Extension of the Provisional NSA). A failure to comply and/or remain in compliance with any of these commitments and undertakings shall constitute a failure to meet a condition of the STA and grounds for declaring the STA terminated without further action on the part of the Commission. Failure to meet a condition of the STA may also result in monetary sanctions or other enforcement action by the Commission. A copy of the Petition, the April 7, 2020 Provisional NSA, and the Third Extension of the Provisional NSA may be viewed on the FCC website through the International Bureau Filing System (IBFS) by searching for SCL-STA-20210817-00033 and accessing "Other filings related to this application" from the Document Viewing area. GU Holdings acknowledges that grant of the STA will not prejudice action by the Commission on the underlying application and that the STA is subject to cancellation or modification upon notice without a hearing. We grant the request for special temporary authority (STA) filed on August 17, 2021 by GU Holdings Inc. and Edge Cable Holdings USA, LLC (Edge USA) (together, Applicants), to allow the Applicants to continue to construct, connect, and test the Pacific Light Cable Network (PLCN) while the Commission considers the application for a cable landing license for the cable, SCL-LIC-20200827-00038. On March 26, 2021, the Commission granted an STA to allow the continued construction and testing of PLCN while the Commission considers the application for a cable landing license for the cable.
