In this Order, we cancel a Notice of Apparent Liability for a Forfeiture (NAL) Carlos Lopez, Memorandum Opinion and Order and Notice of Apparent Liability for Forfeiture, DA 21-1213 (MB Sep. 29, 2021). issued to Carlos Lopez (Licensee) for renewal of licenses for FM translator stations K284DB, South Padre Island, Texas, The NAL identified the translator’s callsign as K287BP, which is the callsign listed in that station’s renewal application. However, the translator’s current callsign is K284DB. and K240FC, Conroe, Texas (Stations), for apparently willfully violating section 73.3539 of the Commission’s rules by failing to timely file license renewal applications for the Stations. 2. The NAL correctly noted that the deadline for filing applications for renewal of radio stations licensed to communities in Texas was April 1, 2021, the first day of the fourth full calendar month prior to the Stations’ August 1, 2021, license expiration date. Id. at para. 2, citing 47 CFR §§ 73.1020, 73.3539(a). However, it overlooked the fact that the Commission first issued licenses for the Stations on May 14, 2021. Broadcast Actions, Public Notice, Report No. Pn-2-210518-01 (MB May 18, 2021). It was, therefore, impossible for Licensee to file applications to renew the Stations’ licenses by the April 1, 2021, deadline. Given this and the fact that Licensee filed the renewal applications prior to expiration of the Stations’ licenses, we find that cancellation of the NAL is appropriate. 3. Accordingly, IT IS HEREBY ORDERED that, pursuant to section 504(b) of the Communications Act of 1934, as amended, 47 U.S.C. § 504(b). and sections 0.61, 0.283, and 1.80(f)(4) of the Commission’s rules, 47 CFR §§ 0.61, 0.283, 1.80(f)(4). the Notice of Apparent Liability for a Forfeiture (NAL/Acct. No. MB-201941410051) issued to Carlos Lopez IS CANCELLED. 4. IT IS FURTHER ORDERED, that copies of this Order shall be sent by First Class and Certified Mail, Return Receipt Requested, to Carlos Lopez, 514 Greenway Drive, Corpus Christi, TX 78412, and to his representative, Michael Celenza, 41 Kathleen Crescent, Coram, NY 11727.
