These grants of authority are taken under section 0.261 of the Commission's rules, 47 C.F.R. § 0.261. TO: ACS Long Distance, LLC Notification filed January 15, 2021 of the pro forma assignment of the cable landing license for the AKORN Cable System, SCL-LIC-20071025-00018, which connects Alaska and Oregon, from ACS Long Distance, Inc. to ACS Long Distance, LLC, effective January 1, 2013. ACS Long Distance converted from an Alaska corporation to an Alaska limited liability company. SCL-MOD-20210105-00001 E Aqua Comms (Americas) Inc Modification Grant of Authority Date of Action: 02/10/2021 Request of Aqua Comms (Americas) Inc. (Aqua Comms Americas) to modify the condition placed on the cable landing license for the AEConnect-1 Cable System (AEC-1 Cable, formerly known as Emerald Express), SCL-LIC-20140206-00002. Grant of the license was conditioned on compliance by Emerald Networks Holdings Limited with the commitments and undertakings set forth in the October 1, 2014, letter from Gregory Varisco, President, Emerald Networks Holdings Limited, to the Assistant Secretary, Office of Policy, Department of Homeland Security (2014 LOA). See Actions Taken Under Cable Landing License Act, SCL-LIC-20140206-00002, Public Notice, Report No. SCL-00156, 29 FCC Rcd 12743 (IB 2014). The AEC-1 cable system connects the United States, Iceland, and Ireland and commenced service on May 5, 2016. Effective January 5, 2021, Aqua Comms Americas executed a new letter of assurances to address national security and law enforcement concerns relating to the ownership and operation of the AEC-1 Cable System. See Letter dated January 5, 2021 from Michael P. Sauer, VP Americas, Aqua Comms (Americas) Inc. to the Assistant Secretary for Trade and Economic Security, Office of Strategy, Policy, and Plans, Department of Homeland Security (2021 LOA). Aqua Comms Americas requests that the Commission modify the cable landing license to require compliance with the 2021 LOA rather than the 2014 LOA. Accordingly, we modify the cable landing license for the AEC-1 Cable System, SCL-LIC-20140206-00002, to condition it on compliance by Aqua Comms Americas with the commitments and undertakings set forth in the 2021 LOA. A failure to comply and/or remain in compliance with any of these commitments shall constitute a failure to meet a condition of the cable landing license and thus grounds for declaring the license terminated without further action on the part of the Commission. Failure to meet a condition of the license may also result in monetary sanctions or other enforcement action by the Commission.
