By the Chief, Audio Division, Media Bureau:

1. In this Order, we cancel a Notice of Apparent Liability for Forfeiture Big Pine Paiute Tribe of the Owens Valley, Memorandum Opinion and Order and Notice of Apparent Liability for Forfeiture, DA 21-1559 (MB Dec. 14, 2021) (NAL).
 issued to Big Pine Paiute Tribe of the Owens Valley (Licensee), licensee of Station KOGI-LP, Big Pine, California (Station), for apparently willfully violating section 73.3539 of the Commission’s rules by failing to timely file a license renewal application for the Station.
2. The NAL correctly noted that the deadline for filing applications for renewal of radio stations licensed to communities in California was August 1, 2021, the first day of the fourth full calendar month prior to the Station’s December 1, 2021, license expiration date. Id. at para. 2 (citing 47 CFR §§ 73.1020, 73.3539(a)). 
  The NAL further stated that the Licensee had not provided an explanation for its failure to timely file the Station’s license renewal application. Id. at para. 2. 
  However, Licensee had requested from the Media Bureau staff permission to file the application by October 1, 2021, without adverse action, Email from Danelle Gutierrez, Big Pine Paiute Tribe of the Owens Valley, to Nazifa Sawez, Audio Division, FCC Media Bureau (Sep. 1, 2021, 7:56 PM EDT).
 and the Bureau staff granted Licensee this extension request. Email from Nazifa Sawez, Audio Division, FCC Media Bureau, to Danelle Gutierrez, Big Pine Paiute Tribe of the Owens Valley (Sept 2, 2021, 5:59 AM EDT).
  Licensee filed the application on September 21, 2021, before the extended deadline.
3. Accordingly, IT IS HEREBY ORDERED that, pursuant to section 504(b) of the Communications Act of 1934, as amended, 47 U.S.C. § 504(b).
 and sections 0.61, 0.283, and 1.80(f)(4) of the Commission’s rules, 47 CFR §§ 0.61, 0.283, 1.80(f)(4).
 the Notice of Apparent Liability for a Forfeiture (NAL/Acct. No. MB-202141410062) issued to Big Pine Paiute Tribe of the Owens Valley IS CANCELLED and the application for renewal of license filed by Big Pine Paiute Tribe of the Owens Valley for Station KOGI-LP, Big Pine, California (File No. 0000159902) IS GRANTED.
4. IT IS FURTHER ORDERED that copies of this Order shall be sent by First Class and Certified Mail, Return Receipt Requested, to Big Pine Paiute Tribe of the Owens Valley, c/o Danelle Gutierrez, PO Box 700, Big Pine, CA 93513.
