INTRODUCTION 1. AT&T filed a Formal Complaint against Aureon in the above-captioned proceeding on June 8, 2017 (Complaint). The Commission granted AT&T’s Complaint, in part, and then later resolved the Parties’ petitions for reconsideration. See AT&T Corp. v. Iowa Network Services, Inc., d/b/a Aureon Network Services, Memorandum Opinion and Order, 33 FCC Rcd 9677 (2017); Order on Reconsideration, 33 FCC Rcd 7964 (2018); Second Order on Reconsideration, 33 FCC Rcd 11855 (2018). 2. Both parties subsequently filed petitions for review, which the U.S. Court of Appeals for the D.C. Circuit granted in part, and denied in part, on August 4, 2020. See AT&T Corp. v. FCC, 970 F.3d 344 (D.C. Cir. 2020). 3. On June 23, 2021, the Parties’ jointly moved to dismiss the Complaint with prejudice because they have entered into a settlement agreement. Joint Motion to Dismiss Formal Complaint, Proceeding No. 17-56, Bureau ID No. EB-17-MD-001 (filed June 23, 2021) (Joint Motion). 4. We are satisfied that granting the Joint Motion will serve the public interest by promoting the private resolution of disputes, eliminating the need for further litigation, and conserving the resources of the Parties and this Commission. II. ORDERING CLAUSE 5. Accordingly, IT IS ORDERED that, pursuant to sections 4(i), 4(j), 201, 203, and 208 of the Communications Act, 47 U.S.C. §§ 154(i), 154(j), 201, 203, and 208, and sections 0.111, 0.311, and 1.720-1.740 of the Commission’s rules, 47 CFR §§ 0.111, 0.311, 1.720-1.740, that the Joint Motion IS GRANTED and that this proceeding IS DISMISSED WITH PREJUDICE.
