INTRODUCTION 1. On May 21, 2021, the above-named Complainants (collectively, CenturyLink) filed with the Commission a formal complaint (Complaint) CenturyLink Communications, LLC, et al. v. Teliax Colorado, LLC, Proceeding Number 21-194, Bureau ID Number EB-21-MD-001 (May 21, 2021) (Complaint). against the above-named defendant, (Teliax) pursuant to section 208 of the Communications Act of 1934, as amended (Act), 47 U.S.C. § 208. and section 1.720 et seq. of the Commission’s rules. 47 CFR §§ 1.720-1.740. The Complaint alleges that Teliax, a competitive local exchange carrier, violated sections 201(b) and 203 of the Act 47 U.S.C. § 201(b). by assessing certain end office and tandem switching charges under its tariff. See Complaint. 2. On July 7, 2021 the parties filed a joint motion to dismiss the Complaint with prejudice. Joint Motion to Motion to Dismiss Complaint with Prejudice, Proceeding Number 21-194, Bureau ID Number EB-21-MD-001 (July 7, 2021) (Motion). The parties state in the Motion that they settled the disputes giving rise to the Complaint pursuant to a confidential settlement agreement and they jointly seek dismissal of the Complaint with prejudice. Motion at 1-2. 3. We are satisfied that granting the Motion will serve the public interest by promoting the private resolution of disputes and eliminating the need for further litigation and the expenditure of additional time and resources of the parties and this Commission. II. ORDERING CLAUSE 4. Accordingly, IT IS ORDERED, pursuant to sections 1, 4(i), 4(j), 201(b), 203 and 208 of the Communications Act of 1934, as amended, 47 U.S.C. §§ 151, 154(i), 154(j), 201(b), 203, and 208, and the authority delegated in sections 0.111, 0.311, and 1.720 - 1.740 of the Commission’s rules, 47 CFR §§ 0.111, 0.311, and 1.720 - 1.740, that the Motion IS GRANTED, and that the Complaint in this proceeding IS DISMISSED with prejudice.
